RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01493 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: a. Her records be corrected to eliminate the gap in service between her active duty (AD) date of separation (DOS) and her entry into the Air Force Reserve. b. Her Time in Grade (TIG), Pay Date, and any other service dates that were adversely affected by the above mentioned gap in service be corrected. APPLICANT CONTENDS THAT: The error is no fault of her own, but rather a delay within the Secretary of Defense’s office in getting her scroll approved prior to her date of separation. Her servicing recruiter submitted her scroll for approval in March 2014 (well before her DOS of 21 Jul 14). The scroll was approved on 21 Aug 14, thus creating an improper gap in her service dates. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 1 Jun 05, the applicant entered the Regular Air Force. On 24 Mar 14, the applicant’s, AF Form 1288, Application for Ready Reserve Assignment, nominee package was signed and submitted. On 21 Jul 14, the applicant was furnished a Honorable discharge, and was credited with 9 years, 1 month, and 21 days of active service. On 21 Aug 14, the applicant was appointed into the Air Force Reserve. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: ARPC/DPA recommends to grant relief, indicating there is evidence of an error or injustice warranting changing the applicant’s date of separation (DOS) to 20 Aug 14. Due to a delay in processing the application at the Secretary of Defense level, the applicant incurred a break in service between her DOS and her appointment into the Air Force Reserve. It has been determined current polices do not allow for backdating oaths; however, SAF/GCM and the AFBCMR has the authority to adjust the DOS for these officer to prevent a break in service. After a thorough review of the facts of this case, this advisor found no administrative error and conclude the break in service was at no fault of the applicant, therefore, they advise the Board grant the applicant’s request to eliminate the break in service and adjust her DOS. A complete copy of the AFRC/DPAR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Sep 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that on 21 July 2014, she did not tender her resignation and was not discharged from all Regular Air Force appointments, but on that date, was continued on active duty until 20 August 2014, on which date she tendered her resignation, was discharged from all active Regular Air Force appointments, and was then released from active duty.
