IN THE MATTER OF: DOCKET NUMBER: BC-2015-01503 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be updated to reflect the following awards and decorations: 1.  Air Force Longevity Service Ribbon with one oak leaf cluster (AFLSM w/1BOLC). 2.  South West Asia Service Medal with two bronze stars (SWASM w/2BSS). 3.  Humanitarian Service Medal (HSM). (Administratively resolved). 4.  Armed Forces Service Medal (AFSM). 5.  Nuclear Deterrence Operations Service Medal (NDOSM) with “N” device and three oak leaf clusters (NDOSM w/N device & 3 BOLC). 6.  Kuwait Liberation Medal – Saudi Arabia (KLM (SA)). 7.  Kuwait Liberation Medal – Kuwait (KLM (K)) APPLICANT CONTENDS THAT: He wants his DD Form 214 updated to reflect the awards he is entitled to, but was not aware of when he was discharged. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 24 Aug 89. On 22 Sep 96, the applicant was furnished an honorable discharge, and was credited with 7 years, and 29 days of active service, to include 3 years, 5 months, and 26 days of foreign service. On 27 Oct 15, AFPC/DPSOR rendered the applicant a DD Form 215, Correction to DD Form 214, Certificate of Release or Discharge From Active Duty, awarding him the HSM, NDOSM w/N Device & 1BOLC, and correcting his SWASM w/1BSS to a SWASM w/3BSS. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice warranting award of the following requested awards: a) AFLSM w/1BOLC - The applicant's dates of active duty service were from 24 Aug 89 to 22 Sep 96 for a total of 7 years and 29 days. The applicant is ineligible for award of the Bronze Oak Leaf Cluster for the Air Force Longevity Service Award as he did not complete 8 years of qualifying active duty service. b) NDOSM w/N device & 3 BOLC – They were able to verify the applicant served at a qualifying location for which he met the criteria for the basic award of the Nuclear Deterrence Operations Service Medal with N device, and had a permanent change of assignment to another qualifying location for which he also met the award criteria rendering him eligible for the Nuclear Deterrence Operations Service Medal with N device and one Bronze Oak Leaf Cluster. However, the applicant did not complete two more permanent changes of assignment to qualifying locations for award of a total of three Bronze Oak Leaf Clusters. Subsequent awards will only be authorized when a permanent change of station to a qualifying unit has occurred. c) AFSM - In accordance with R 221730Z Jul 98 8106 message concerning the Armed Forces Service Medal (AFSM) for Operation PROVIDE COMFORT, no service member shall receive both the AFSM and the SWASM for service in the Southwest Asia Theater of operations. They were able to confirm he was awarded the SWASM w/3BSS. Recommend the applicant advise the board if he would like to keep award of the SWASM w/3BSS or if he would like to exchange it for award of the AFSM. d) KLMs (SA & K) - The applicant was eligible for the SWASM due to being in Egypt in support of Operations DESERT STORM/SHIELD; however, Egypt is not considered the area of eligibility for either of the Kuwait Liberation Medals. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant refutes the OPR’s advisory that he did not complete 8 years of qualifying active duty service. In support of his response, he provided copies of his Air Force Reserve orders contending that the orders should prove he had more than enough time to qualify for the AFLSM w/1BOLC. He indicated he would forego the AFSM and retain the SASM w/3BSS. He still questions the criteria for the KLM in respect to someone on a ship twice as far away being authorized the KLM, while he being located in Egypt was not. A complete copy of the applicant’s response is at Exhibit E. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The applicant was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago and the application is therefore untimely, however, it is in the interest of justice to excuse the failure to timely file. . 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting award of the Air Force Longevity Service Ribbon with one oak leaf cluster (AFLSM w/1BOLC), Nuclear Deterrence Operations Service Medal (NDOSM) with “N” device and three oak leaf clusters (NDOSM w/N device & 3 BOLC), Kuwait Liberation Medal – Saudi Arabia (KLM (SA)), Kuwait Liberation Medal – Kuwait (KLM (K)). We took notice of the applicant’s complete submission in judging the merits of the case, to include his rebuttal; however, we agree with the opinion and recommendation of AFPC/DPSID and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice in respect to the requested relief noted above. Specifically, we note that after a review of the orders provided by the applicant and his ANG/USAFR Point Credit Summary, it was determined the applicant did not qualify for award of the AFLSM w/1BOLC. Additionally, the applicant’s records revealed he did not meet the criteria established for award of the NDOSM w/N device & 3 BOLC, KLM (SA), or KLM (K). After review of the AFPC/DPSID Advisory, since he already received award of the SWASM for his deployment in support of Operation DESERT SHIELD/STORM, the applicant advised the Board he wanted to forego the Armed Forces Service Medal (AFSM) and retain the South West Asia Service Medal. Notwithstanding the above, we note that AFPC/DPSID was able to determine the Humanitarian Service Medal (HSM), the Nuclear Deterrence Operations Service Medal (NDOSM) with “N” device and one oak leaf cluster (NDOSM w/N device & 1 BOLC), and the South West Asia Service Medal with three bronze stars (SWASM w/3BSS), should have been awarded during his service from 24 Aug 89 to 22 Sep 96, and will administratively correct his record to reflect such. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
