RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-01812 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. The Army Commendation Medal (ARCOM) rendered for the period 12 Dec 94 to 23 Nov 97 be filed in his official military record. 2. He receive supplemental promotion consideration for the Fiscal Year 2010 (FY 10E7) master sergeant (MSgt) promotion board. 3. He receive back pay from 2010 to 2012 as a MSgt (E-7). 4. His retired pay be adjusted to reflect his final three years as an E-7. APPLICANT CONTENDS THAT: The ARCOM is worth 3 points and had it been in his records he would have made the cutoff score for promotion to E-7 and would have been promoted to MSgt in 2010. If he had been promoted in 2010, he would have received higher retirement pay. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to documents submitted by the applicant, he is a former service member of the Army Reserve, Regular Army and Army National Guard. According to documents extracted from his military personnel record (MPR) the applicant commenced his enlistment in the Regular Air Force on 10 May 01; was released from active duty on 31 Mar 15, and on 1 Apr 15, he was retired in the grade of master sergeant (MSgt), E-7, and was credited with 20 years and 23 days of active service. On 9 Apr 15, the Army Board for Correction of Military Records (ABCMR) granted relief and awarded the applicant the Army Commendation Medal (ARCOM) for meritorious service for the period 12 Dec 94 to 23 Nov 97. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. While award of the ARCOM has been verified by the ABCMR, the special order and citation for the award has not been provided. Without the special order and citation the requested relief cannot be granted. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. AFPC/DPSOE recommends denial of the applicant’s request for supplemental promotion consideration to MSgt for cycle 10E7 indicating there is no evidence of an error or an injustice. While the ABCMR approved award of the ARCOM, it does not automatically entitle the applicant to supplemental consideration for cycle 10E7 as the decoration was not a matter of record when selects were run for that cycle. The ARCOM is worth 3 points and if it had been approved and awarded in 1997, the first time it would have been used in the promotion process would have been for 04E6 promotion cycle to technical sergeant (TSgt), E-6. The applicant was considered for promotion to TSgt three times prior to being selected for promotion to E-6. Supplemental promotion consideration for cycles 04E6 and 05E6 is not warranted as the applicant’s scores would not have increased enough to render him a select for either cycle. Based on the applicant’s date of rank (DOR) to TSgt, the next time the contested decoration would have been used in the promotion process was cycle 09E7 to MSgt. He was considered for promotion to MSgt four times before being selected during cycle 12E7. Supplemental promotion consideration for cycle 09E7 is not warranted as his scores would not have increased enough to render him a select. However, if relief is granted his weighted points for decorations would increase enough to render him a select. The applicant then would be eligible for supplemental consideration to senior master sergeant (SMSgt) beginning with cycle 13E8. However, based on his current date of rank (DOR) to MSgt, he was never eligible to test for SMSgt prior to his 31 Mar 15 retirement. Without a test on file, the applicant could not be considered for supplemental promotion consideration to SMSgt for cycle 13E8. A complete copy of the AFPC/DPSOE evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 29 Oct 15, for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request to have the Army Commendation Medal added to his military records, supplemental promotion consideration and back pay. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force offices of primary responsibility (OPR) and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. While the applicant has provided documentation from the Army Board for Correction of Military Records approving award of the Army Commendation Medal (ARCOM), without the citation and special order, we do not find the evidence sufficient to grant the requested relief. However, should the applicant provide the citation and special order awarding the ARCOM; we would be willing to review his request for possible reconsideration. In view of this determination, there exists no basis upon which to recommend favorable consideration on the remainder of the applicant’s requests. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
