RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02003 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: A review of his military record be completed to determine the awards and decorations he earned during his time in service and his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected accordingly. He be provided an initial issue for these awards and decorations and replacements for those that were retroactive from Vietnam but never received (administratively corrected). APPLICANT CONTENDS THAT: He was assigned to Vietnam from 18 Sep 70 to 18 Sep 71 and served with several units while at Tuy Hoa and Can Rahn Bay. He did receive the Vietnam Service Medal (VSM) but may be entitled to the VSM with three service stars. He may also be entitled to multiple awards of the Air Force Outstanding Unit Award (AFOUA) with combat V device, multiple awards of Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) and possibly a Presidential Unit Citation (PUC). The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 17 Jan 68, the applicant entered the Regular Air Force. From 20 Sep 70 to 18 Sep 71, according to the applicant’s AF Form 7, Airman Military Record, he was assigned to the 1881 Communications Squadron, Cam Ranh Bay, Vietnam On 18 Sep 71, the applicant was furnished an honorable discharge, and was credited with three years, eight months, and two days of active service, which included two years, seven months and six days of foreign service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The PUC is awarded to units of the Armed Forces of the United States and cobelligerent nations for extraordinary heroism in action against an armed enemy occurring on, or after, 16 Oct 41, for United States Navy and United States Marine Corps units, and on or after 7 December 1941, for United States Army units. The unit must have displayed such gallantry, determination, and esprit de corps in accomplishing its mission under extremely difficult and hazardous conditions to have set it apart and above other units participating in the same campaign. The degree of heroism required is the same as that which would be required for award of a Distinguished Service Cross to an individual. After a thorough review of the applicant’s military record, it was not possible to locate official documentation to verify the applicant was assigned or attached to a unit that received award of the PUC. Additionally, no evidence was found to verify multiple awards of the AFOUA with Valor for service with the 483rd Security Police Squadron because official documentation that the applicant was assigned or attached to this unit could not be found. While we are able to verify award of the RVNGC w/P, devices are not authorized to denote multiple awards. Thus, the applicant is ineligible to receive multiple awards of the RVNGC w/P. The review of the applicant's official military personnel record did verify award of the AFOUA w/V and 1BOLC, the VSM w/3BSS, the RVNGC w/P, and Vietnam Campaign Medal (VCM) for his service with the 1881 Communications Squadron between 20 Sep 70 and 18 Sep 71. Upon final board decision, the applicant's official military personnel record will be administratively corrected. A one-time replacement/initial issue of the awards and decorations earned by the applicant, except for the RVNGC w/P, and VCM which are foreign awards and not stocked or issued by the U.S government, has been provided to the applicant. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. ? APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 29 Oct 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to grant award of the PUC, multiple awards of the AFOUA w/Valor and multiple awards of the RVNGC w/P. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. We do note the review of the applicant’s military personnel record did verify award of the AFOUA w/V and 1BOLC, the VSM w/3BSS, the RVNGC w/P, and Vietnam Campaign Medal (VCM), and will be administratively corrected. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
