RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2015-02565 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1.  The Abdominal Circumference (AC) score be removed from her May 13 Fitness Assessment (FA). 2.  The referral Officer Performance Report (OPR) rendered for the period 23 May 12 to 22 May 13, be removed from her records. 3.  She be given Special Selection Board (SSB) consideration for the CY14 Biomedical Science Corps (BSC) Major Promotion Board. APPLICANT CONTENDS THAT: The Physical Training Leader (PTL) measured her abdominal circumference in the incorrect location according to AFI 36-2905, Fitness Program, resulting in a FA failure. As a result of the FA failure, she received a referral OPR, which resulted in her not being selected for promotion at the CY14 BSC Major Promotion Board. During this time frame the PTLs were not correctly conducting the AC measurement portion of the FA. In support of her contention she provides letters/documentation submitted to the Fitness Assessment Appeals Board (FAAB), wing commander, and a letter submitted by her Primary Care Physician, regarding the FA AC measurements. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 30 Jun 08. On 25 Apr 13, according to documents provided by the applicant, she was unable to complete her FA, due to becoming distraught, after disagreeing with the PTL’s measurement of her AC (36”, failure). This FA was removed from her records by the Wing Commander as a result of the advice from her flight commander to not complete the remaining FA components due to her emotional state. On 15 May 13, the applicant failed her FA (overall score 64.8/Unsatisfactory) as a result of an AC measurement of 36”. On 7 Jun 13, she was rendered a referral OPR for the period 23 May 12 to 22 May 13. On 27 Jan 14, according to documents provided by the applicant, she requested her wing commander to remove her 25 Apr 13 and 15 May 13 FAs from the Air Force Fitness Management System (AFFMS). The wing commander approved removing the AC measurement from the 25 Apr 13 FA. On 10 Apr 14, according to documents provided by the applicant, she submitted a FA Appeal to the FAAB. On 1 Jul 14, according to documents provided by the applicant, the FAAB disapproved her request based on a lack of sufficient evidence showing there were testing administration errors due to PTLs/augmentees improperly conducting abdominal circumference measurements. On 31 Jan 16, as a result of non-selection, permanent promotion, the applicant was furnished an honorable discharge, and was credited with seven years, seven months, and one day of active service. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or an injustice. A review of the applicant’s records revealed her appeals for removal of her 15 May 13 FA were disapproved by her wing commander and the FAAB. She did not present sufficient evidence to support her contentions that there were errors in the testing administration due to improperly conducting abdominal circumference measurement on the 15 May 13 FA. They recommend denial on the same basis as the FAAB: the applicant did not present any evidence substantiating there were testing administration error due to PTLs/augmentees improperly conducting abdominal circumference measurements. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice warranting voiding her contested OPR. In Jan 2010 senior AF leadership strengthened the AF Fitness program, stating that “It is every Airman’s responsibility to maintain standards set forth in the new AFI 36-2905. Her request to remove the 15 May 13 FA was disapproved by her wing commander and the FAAB, for not providing sufficient documentation or evidence supporting her assertions that the contested FA was rendered unfairly or unjustly. An evaluation report is considered to represent the rating chain’s best judgement at the time it is rendered. Once a report is accepted for file, only strong evidence to the contrary warrants correction or removal from an individual’s record. The burden of proof is on the applicant. She has not substantiated that the contested report was not rendered in good faith by all evaluators based on knowledge available at the time. The removal of her contested OPR should be denied. A complete copy of the AFPC/DPSID evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 31 Mar 16 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility (OPR) and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Based on the OPRs recommendations to deny the requested relief of removing the Abdominal Circumference (AC) score from the applicant’s May 13 Fitness Assessment (FA), and removal of her referral Officer Performance Report (OPR) rendered for the period 23 May 12 to 22 May 13, there is no basis for the Board’s consideration of her requested relief for Special Selection Board (SSB) consideration for the CY14 Biomedical Science Corps (BSC) Major Promotion Board. Therefore, in the absence of persuasive evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
