RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS. IN THE MATTER OF: DOCKET NUMBER: BC-2015-03000 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: A copy of his DD Form 4, Enlistment/Reenlistment Document Armed Forces of the United States, Block 3, Home of Record, dated 17 Apr 09, be corrected to reflect “Tamuning, GQ 96931.” APPLICANT CONTENDS THAT: He did not verify his Home of Record (HOR) when he reenlisted and would like it corrected to reflect his actual HOR: Tamuning, GQ (Guam). He is in the process of applying for a Designated Location Move for his family member while he serves his overseas unaccompanied tour and need his HOR corrected in order to proceed with his application. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: Member is currently serving in the Regular Air Force in the grade of staff sergeant (E-5). On 25 Apr 06, the applicant’s initial DD Form 4, Block 3, Home of Record, was administratively corrected by the AFBCMR, to reflect Tamuning, GQ. On 17 Apr 09, the applicant reenlisted for four years and four months. His DD Form 4, Block 3, reflected 4286 S. Ranger Trail, Gilbert AZ 85297 as his HOR. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which are attached at Exhibit C and D. AIR FORCE EVALUATION: AFPC/DPSIPE recommends denial indicating there is no evidence of an error or an injustice. The DD Form 4 is the source document for HOR. The Joint Federal Travel Regulation, Volume I, Appendix A1 part 1 states, “The place recorded as the home of the individual when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted or inducted, or ordered into the tour of active duty, unless there is a break in service of more than one full day. Only if a break in service exceeds one full day, the member can change the HOR.” The HOR is the location identified by the individual upon entering the service, not a location where the individual is later assigned or a location selected for convenience; a correction must be fully justified. Domicile or legal residence may change, but the HOR will not. The HOR when separating or retiring is determined by an individual’s initial DD Form 4 and since they have confirmed the applicant’s initial DD Form 4 reflects the correct HOR no action is required. A complete copy of the AFPC/DPSIPE evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 16 Nov 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error or injustice. While we note the comments of AFPC/DPSIPE indicating that relief should be denied because the applicant’s records contain no documentation substantiating the applicant’s contention that his HOR needs to be changed, we believe a preponderance of the evidence substantiates that corrective action is warranted. In this respect, we note the applicant had a previous AFBCMR Case approved to have his initial DD Form 4, Block 3, corrected to reflect “Tamuning, GQ 96931” as his HOR. In their effort to eliminate any future confusion as to what the applicant’s HOR is, the Board recommends the applicant’s records be corrected as indicated. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that on 17 April 2009, the applicant reenlisted and his DD Form 4, Enlistment/Reenlistment Document Armed Forces of the United States, Page 1, Block 3, Home of Record, reflect “Tamuning, GQ 96931.” The following members of the Board considered AFBCMR Docket Number BC-2015-03000 in Executive Session on 2 Feb 16 under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records as recommended.
