2. The applicant requests, in effect, voiding her DD 4/1 (Enlistment/Reenlistment Document) dated 28 April 1997. 3. In August 1996 the applicant enlisted in the USAR. On 25 April 1997 a conditional release was approved by her commander for her to enlist in the Regular Army (RA). 4. On 28 April 1997, while still a member of the USAR, the applicant executed a DD Form 4/1 enlisting in the USAR Delayed Entry Program (DEP) for 8 years, with a active duty reporting date of 6 August 1997. (This action effectively enlisted her in the USAR twice.) 5. On 6 August 1997 the applicant executed a “corrected” DD 4/1 enlisting her in the RA for 6 years. CONCLUSIONS: 1. Based on the evidence of record the DD Form 4/1, dated 28 April 1997, which enlisted her in the USAR DEP is invalid as it caused her to serve under concurrent contracts. 2. Accordingly, it would be appropriate to validate her 6 August 1997 RA enlistment contract. 3. In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by validating the DD 4/1, dated 6 August 1997 of the individual concerned.
