Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of the National Defense Service Medal (NDSM). 2. The applicant states he was on active duty for training in April 2002. He states it is his understanding of MILPER Message Number 02-150 that anyone serving on active duty on or after 11 September 2001 for reasons other than inactive duty training was eligible for the NDSM. 3. The applicant provides no evidence in support of his application. CONSIDERATION OF EVIDENCE: 1. Having prior active duty service in the U.S. Navy, the applicant enlisted in the Army National Guard on 6 April 2000. On 5 April 2001, the applicant was honorably discharged from the Army National Guard. He enlisted in the Army National Guard on 11 December 2001. On 10 December 2003, the applicant was honorably discharged from the Army National Guard. 2. The applicant's Army National Guard Retirement Points History Statement shows he earned 15 active duty points during the period 11 December 2001 through 10 December 2002 and 17 active duty points during the period 11 December 2002 through 10 December 2003. 3. MILPER Message Number 02-150, dated 26 April 2002, provided for the reinstatement of the NDSM for members of the U.S. Armed Forces serving on active duty on or after 11 September 2001 to a date to be determined in the future. The message stated, in pertinent part, that Army National Guard and U.S. Army Reserve forces personnel on short tours of duty to fulfill training obligations under an inactive duty training program would not be considered as performing active service. DISCUSSION AND CONCLUSIONS: Evidence of record shows the applicant performed two short tours on active duty during the period 11 December 2001 to 10 December 2003. One tour may have been for active duty for training as he states; the other appears to have been annual training. However, the governing regulation states that short tours of active duty to fulfill training obligations would not be considered as performing active service. Therefore, there is insufficient evidence on which to base award of the NDSM in this case.
