Barber Member The Board considered the following evidence: Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show award of the Army Good Conduct Medal and his military occupational specialty (MOS) as 21B1O (Combat Engineer) 2. The applicant states that his Army Good Conduct Medal is not shown on his DD Form 214 and that his MOS should be 21B1O. 3. The applicant provides a copy of his DD Form 214, a memorandum showing that he met the eligibility requirements for award of the "Driver Badge (T)", and a memorandum showing his unit assignments and award eligibility for his service in support of Operation Iraqi Freedom. CONSIDERATION OF EVIDENCE: 1. On 23 January 2005, the applicant, a member of the Illinois Army National Guard, was ordered to active duty in support of Operation Iraqi Freedom. 2. On 15 December 2005, the applicant was promoted to the rank of corporal, pay grade E4. 3. A memorandum, Subject: Award of the Driver Badge, 135th Engineer Company, 1st Battalion, 110th Infantry (Mechanized), dated 15 January 2006, documents that the applicant met the eligibility requirements for award of the Driver Badge with "T" Bar, during the period from 27 June 2005 to 31 May 2006. It is signed by the company commander, a captain. 4. A memorandum, Subject: Statement of Service, Headquarters, 1st Battalion, 110th Infantry (Mechanized) dated 15 June 2006, documents that the applicant served in Kuwait from 29 June to 14 July 2005; and in Iraq from 14 July 2005 to 15 June 2006. This memorandum further indicates that he is authorized the following awards: Iraq Campaign Medal, Armed Forces Reserve Medal with “M” Device, National Defense Service Medal (2nd award), Global War on Terrorism Service Medal, and the Overseas Service Ribbon. It is signed by the battalion commander, a lieutenant colonel. 5. On 9 July 2006, the applicant was honorably released from active duty and transferred to the Illinois Army National Guard. He had completed 1 year, 5 months and 17 days of creditable active duty and only had 24 days of prior active duty. 6. Item 11 (Primary Specialty) of the applicant’s DD Form 214 shows his MOS as 92G1O (Food service Operations) and that he had held this MOS for 5 years, and 4 months. 7. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 shows his awards as the Army Commendation Medal, Army Achievement Medal, National Defense Service Medal (2nd award), Iraq Campaign Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Armed Forces Reserve Medal with “M” Device, and the Combat Action Badge. It does not show award of the Army Good Conduct Medal. 8. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.  The current standard for award of the Army Good Conduct Medal is 3 years of qualifying service, but as little as one year is required for the first award in those cases when the period of service ends with the termination of active Federal military service. Denial requires the commander’s disqualifying comments. 9. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, for award of the Driver and Mechanic Badge. The Driver and Mechanic Badge is awarded to drivers, mechanics, and special equipment operators to denote the attainment of a high degree of skill in the operation and maintenance of motor vehicles. A Component bar “Driver-T” is authorized for tracked vehicles. Qualification for award requires: (1) Qualify for and possess a current OF 346 (U.S. Government Motor Vehicles Operator’s Identification Card), issued as prescribed by AR 600–55 and, (2) Be assigned duties and responsibilities as a driver or assistant driver of government vehicles for a minimum of 12 consecutive months, or during at least 8,000 miles with no government motor vehicle accident or traffic violation recorded on his or her DA Form 348–1–R (Equipment Operator’s Qualification Record (Except Aircraft)), or (3) Perform satisfactorily for a minimum period of 1 year as an active qualified driver instructor or motor vehicle driver examiner. DISCUSSION AND CONCLUSIONS: 1. The available records show that the applicant’s MOS is 92G1O, Food Service Specialist. There is no available evidence showing that the applicant received training and/or was awarded another MOS, in particularly, MOS 21B1O. Therefore, the applicant’s request to correct his MOS should not be granted. 2. The evidence of record clearly shows that the applicant served a qualifying period of time for an initial award of the Army Good Conduct Medal. Furthermore, there is no evidence showing that his commander took any action to deny him this award. Therefore, he should be awarded the Army Good Conduct Medal. 3. The evidence clearly shows that the applicant’s commander determined that he had met the requirements for award of the Driver and Mechanic Badge with Driver-T Bar. Therefore, he should be awarded this badge. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him the Army Good Conduct Medal for the period from 23 January 2005 to 9 July 2006; and b. awarding him the Driver and Mechanic Badge with Driver-T Bar, for the period from 27 June 2005 to 31 May 2006. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to award of military occupational specialty 21B1O (Combat Engineer). __ Eric N.
