Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that the DD Forms 214 (Certificate of Release or Discharge from Active Duty) for the periods ending 6 August 2003 and 17 September 2003 be expunged from his military records. 2. The applicant states that he was on active duty from 15 October 2002 through 10 September 2003 and that he received a DD Form 214 for that period of service. However, the DD Forms 214 for the periods ending 6 August 2003 and 17 September 2003 which show his name do not belong to him. He points out that the signatures of the Soldiers being separated on these documents are not his. 3. The applicant provides three DD Forms 214, for the periods ending 10 September 2003, 6 August 2003, and 17 September 2003. CONSIDERATION OF EVIDENCE: 1. The applicant was ordered to active duty on 15 October 2002 in support of Operation Enduring Freedom and was released from active duty on 10 September 2003. He is currently on active duty. 2. The applicant provided a copy of a DD Form 214 for his active duty service during the period 15 October 2002 through 10 September 2003. 3. In support of his claim, the applicant provided two DD Forms 214 for the periods ending 6 August 2003 and 17 September 2003 which contain his name and personal information in items 1 (Name) through 7b (Home of Record). However, the remaining information on these DD Forms 214 contain different entries and the signatures in item 21 (Signature of Member Being Separated) are clearly not the applicant’s name. 4. A review of the applicant’s Service, Military Personnel Records Jacket, and Deployment/Mobilization sections of his Official Military Personnel File on the Personnel Electronic Records Management System reveal a copy of the two DD Forms 214 in question. DISCUSSION AND CONCLUSIONS: Although the DD Forms 214 for the periods ending 6 August 2003 and 17 September 2003 contain the applicant’s name and personal information in items 1 through 7b, the remaining information on these DD Forms 214 contain different entries and the signatures are not the applicant’s name. Evidence of record shows the applicant received a DD Form 214 for the period covering his active duty service (15 October 2002 to 10 September 2003). Therefore, it would be appropriate to expunge these DD Forms 214 from the applicant’s military records.
