THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his Global War on Terrorism Expeditionary Medal be replaced with the Iraq Campaign Medal. 2. The applicant states that per Army Regulation 600-8-22, service members qualified for Global War on Terrorism Expeditionary Medal, by reason of service from 19 March 2003 through 28 February 2005, in an area for which the Iraq Campaign Medal was subsequently authorized, will remain qualified for that medal. He states that, according to Army Regulation 600-8-22, upon application, any such service member may be awarded the Iraq Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. He states that he is a deployed Army Reserve Soldier serving in Afghanistan and that he would like to have his records updated prior to being released from active duty. 3. The applicant provides in support of his application, a copy of a memorandum dated 20 June 2004, awarding him the Global War on Terrorism Expeditionary Medal, by authority of Executive Order 13289; a copy of his Certificate of Release or Discharge from Active Duty (DD Form 214); and a copy of his Enlisted Record Brief. CONSIDERATION OF EVIDENCE: 1. On 8 May 2001, the applicant enlisted in the United States Army Reserve (USAR), under the Delayed Entry Program, in Phoenix, Arizona, for 8 years, in the pay grade of E-1. He enlisted in the Regular Army for 3 years on 18 May 2001 and he successfully completed his training as a light wheel vehicle mechanic. He was transferred to Iraq on 16 March 2004. 2. In a memorandum dated 20 June 2004, the applicant was awarded the Global War on Terrorism Expeditionary Medal, by authority of Executive Order 13289, for service, while deployed abroad in support of Operation Iraqi Freedom, from 16 March 2004 to 14 March 2005. 3. The applicant was honorably released from active duty (REFRAD) on 18 April 2005, upon completion of his required active service and he was transferred to the USAR Control Group (Reinforcement) to complete his remaining service obligation. The DD Form 214 that he was furnished at the time of his REFRAD shows that he was awarded the Army Commendation Medal (2nd Award), Army Achievement Medal (2nd Award), Army Superior Unit Award, Army Good Conduct Medal, National Defense Service Medal, Global War on Terrorism Expeditionary Medal, Global War on Terrorism Service Medal, Kosovo Campaign Medal, Overseas Service Ribbon, NATO Medal (Kosovo), Sharpshooter Marksmanship Qualification Badge with Rifle Bar, Driver and Mechanic Badge with Driver-W Bar, and the Mechanic Badge. 4. Army Regulation 600-8-22 (Military Awards) states that individuals authorized the Iraq Campaign Medal must have served in direct support of Operation IRAQI FREEDOM (OIF). The area of eligibility encompasses all land area of the country of Iraq, and the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of OIF. 5. Service members qualified for the Global War on Terrorism Expeditionary Medal by reason of service between 19 March 2003 and 28 February 2005, in an area for which the Iraq Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Iraq Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. No service member will be entitled to both medals for the same act, achievement or period of service. DISCUSSION AND CONCLUSIONS: 1. The applicant was awarded the Global War on Terrorism Expeditionary Medal based on his service in Iraq between 19 March 2003 and 28 February 2005. 2. However, in accordance with the applicable regulation, he is entitled to be awarded the Iraq Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal and his records should be corrected to reflect the award of his choice. 3. In view of the forgoing, it would now be in the interest of justice to correct the applicant's records as recommended below.
