THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that he be awarded the Global War on Terrorism Service Medal (GWOTSM) and the Armed Forces Reserve Component Overseas Training Ribbon (AFRCOTR). 2. The applicant states that he was mobilized, deployed and served under presidential call-up for Operation Noble Eagle II between 9 September 2002 and 21 February 2003. He also states that he trained with the 40th Military Police Company at Vilsec, Germany during annual training from 20 May to 3 June 2000. 3. The applicant provides a copy of his DD Form 214 and a copy of his temporary duty (TDY) orders to Germany and his NATO Travel Order. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the California Army National Guard (CAARNG) on 11 February 1998 for a period of 8 years and training as a military policeman. He completed his training at Fort McClellan, Alabama and was returned to his CAARNG unit. 2. On 17 March 2000, orders were published by the CAARNG ordering the applicant to active duty for training (ADT) in Germany for the period of 20 May 2000 to 3 June 2000. 3. On 9 September 2000, the applicant was ordered to active duty in support of Operation Nobel Eagle. He was mobilized to Fort Lewis, Washington and remained there until he was released from active duty on 21 February 2003. He had served 5 months and 13 days of active duty during his mobilization and his DD Form 214 reflects that he was awarded the National Defense Service Medal and the Armed Forces Reserve Medal with “M” Device. 4. Army Regulation 600-8-22 (Military Awards), in pertinent part, provides for award of the Army Reserve Components Overseas Training Ribbon (ARCOTR). It is awarded to members of the Reserve Components of the Army, (Army National Guard and U.S. Army Reserve), for successful completion of annual training (AT) or active duty for training (ADT) for a period not less than 10 consecutive duty days on foreign soil. Numerals will be used to denote second and subsequent awards of the ARCOTR. 5. Army Regulation 600-8-22 (Military Awards) states that the Global War on Terrorism Service Medal (GWOTSM) is authorized for award to members of the Armed Forces of the United States who have participated in the Global War on Terrorism (GWOT) operations outside of the designated areas of eligibility (AOE), on or after 11 September 2001 to a future date to be determined. Battalion commanders and commanders of separate units have the authority to award the GWOTSM for approved operations to units and personnel within his or her command. Service members must be assigned, attached, or mobilized to a unit supporting designated operations for 30 consecutive days or for 60 nonconsecutive days, or meet one of the following criteria: (1) Initial award of the GWOTSM is limited to airport security operations (from 27 September 2001 through 31 May 2002) and Soldiers who supported Operations NOBLE EAGLE, ENDURING FREEDOM, and IRAQI FREEDOM, or (2) all Soldiers on active duty, including Reserve Component Soldiers mobilized, or National Guard Soldiers activated on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM. DISCUSSION AND CONCLUSIONS: 1. The applicant performed 14 days of annual training in Germany from 20 May to 3 June 2000 and therefore is entitled to be awarded the ARCOTR. 2. He was also mobilized in support of Operation Noble Eagle during the period of 9 September 2002 to 21 February 2003 and therefore is entitled to be awarded the GWOTSM. 3. Accordingly, it would be in the interest of justice to award him the ARCOTR and the GWOTSM and to correct his records accordingly.
