Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that the 19 March 2004 orders for her third award of the Good Conduct Medal be removed from her Official Military Personnel File (OMPF). 2. The applicant states that a third award of the Good Conduct Medal for the period 7 March 2000 to 6 March 2003 was already posted to her records and that the 19 March 2004 orders are a duplicate. 3. The applicant provides revocation orders, dated 17 March 2008; and orders, dated 19 March 2004, for the third award of the Good Conduct Medal. CONSIDERATION OF EVIDENCE: 1. The applicant is currently serving on active duty in the rank of staff sergeant. 2. Headquarters, Delta Detachment, 55th Personnel Services Battalion, Permanent Order Number 249-11, dated 6 September 2003, shows the applicant was awarded the third award of the Good Conduct Medal for the period 7 March 2000 to 6 March 2003. 3. Headquarters, Delta Detachment, 55th Personnel Services Battalion, Permanent Order Number 079-15, dated 19 March 2004, shows the applicant was awarded the third award of the Good Conduct Medal for the period 7 March 2000 to 6 March 2003. These orders were revoked by Headquarters, 507th Corps Support Group Permanent Orders 076-001, dated 17 March 2008. 4. A review of the applicant’s performance and Military Personnel Records Jacket (MPRJ) sections of her OMPF on the Personnel Electronic Records Management System revealed a copy of the 19 March 2004 Good Conduct Medal orders. The revocation orders are not yet filed on her OMPF. 5. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) provides policies, operating tasks, and steps governing the OMPF. Table 2-1 of this Army regulation shows that award orders are filed in the performance section of the OMPF. DISCUSSION AND CONCLUSIONS: 1. The regulatory guidance is to file award orders in the performance section of the OMPF. 2. However, there is a viable reason for removing Headquarters, Delta Detachment, 55th Personnel Services Battalion, Permanent Order Number 079-15, dated 19 March 2004, and removing Headquarters, 507th Corps Support Group Permanent Orders 076-001, dated 17 March 2008, from the applicant’s OMPF (or ensuring that the latter orders are not filed in her OMPF). These two orders offer no relevant information regarding the applicant’s service, conduct, or duty performance. Moreover, removing them would eliminate the potential for confusion to officials authorized to review the performance section of the applicant’s OMPF.
