THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of duplicate Permanent Orders 346-001, Department of the Army, Headquarters, 4th Battalion, 319th Airborne Field Artillery Regiment, 173rd Airborne Brigade Combat Team, dated 12 December 2007, awarding him the Army Good Conduct Medal (AGCM)(5th Award), "4th Clasp." 2. The applicant states, in effect, that this is a duplicate order and that the award of the AGCM (5th Award), 4th Clasp is incorrect. There is a correct order posted to his Official Military Record File (OMPF) awarding him the AGCM (5th Award). 3. The applicant provides a copy of his correct AGCM (5th Award) orders. CONSIDERATION OF EVIDENCE: 1. The applicant is a sergeant first class (SFC)/E-7 in the Regular Army. 2. Permanent Orders 346-001, dated 12 December 2007, awarded the applicant the AGCM (5th Award). 3. A review of the applicant's OMPF on the Integrated Personnel Electronic Records Management System (iPERMS) shows 2 orders awarding him the AGCM (5th Award) with the same date. The incorrect order has the following in the leadline: "Award: USA GOOD CONDUCT MEDAL 5TH AWARD, 4TH CLASP." 4. Army Regulation 600-8-22 (Military Awards) provides that the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. 5. Paragraph 4-9 of Army Regulation 600-8-22 stipulates, in pertinent part, that a clasp is authorized for wear on the AGCM to denote a second or subsequent awards. For the 5th award of the AGCM a bronze clasp with 5 loops is authorized. DISCUSSION AND CONCLUSIONS: 1. The applicant's OMPF contains an erroneous, duplicate copy of his AGCM (5th award) permanent orders. 2. Given the above, the applicant's record should be corrected as shown below.
