THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his military records to show that he enrolled in the Montgomery GI Bill (MGIB) Program. 2. The applicant states that he did not fully understand what the MGIB Program was until after his arrival at his first permanent duty station where the program was explained to him by the education counselor. Now that he understands what the program is, he wants to enroll and pay the $1,200.00. 3. The applicant provides a copy of his MGIB Basic Enrollment (DD Form 2366) dated 14 January 2008 and his enlistment contract. CONSIDERATION OF EVIDENCE: 1. At the time of his application, the applicant was serving as a private on active duty in the Regular Army. 2. On 8 December 2007, the applicant enlisted in the Regular Army for 3 years. 3. On 14 January 2008, the applicant signed a DD Form 2366 declining to participate in the MGIB Program. This form clearly states that he would not be able to enroll at a later date. The form was signed by a certifying official. DISCUSSION AND CONCLUSIONS: 1. The evidence of record clearly shows that the applicant declined to participate in the MGIB Program and that he was properly informed that he would not be able to enroll at a later date. 2. However, based on the applicant’s contention that he did not fully understand what the MGIB Program was until after arrival at his first duty station, and as a matter of equity, he should be granted an exception to policy in this case. 3. In view of the above, the applicant’s records should be corrected to show that he elected to participate in the MGIB Program.
