THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be reissued to show his blood type as B Positive. 2. The applicant states he discovered in 1983 that his blood type was actually B Positive, but he simply forgot to get around to correcting his records. 3. The applicant provides his DD Form 214 and a laboratory report. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 29 September 1969. He was honorably released from active duty on 5 April 1972. 3. Item 30 (Remarks) on the applicant’s DD Form 214 shows his blood group as B Negative. 4. The applicant provided a laboratory report, dated 4 June 2008, that shows his blood type is B Positive. 5. Army Regulation 635-5 (Separation Documents) establishes the policies and procedures for completion and distribution of the DD Form 214. In pertinent part, it states a DD Form 214 will not be reissued unless directed by proper appellate authority, unless it is determined that required corrections will not fit within the space on a single DD Form 215 (Correction to DD Form 214), unless two DD Forms 215 have already been issued and another correction is required, or unless the character of service is changed. DISCUSSION AND CONCLUSIONS: Item 30 of the applicant’s DD Form 214 erroneously shows his blood type as B Negative and should be corrected (not reissued) to show his blood type as B Positive. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
