THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his request to be awarded the Combat Infantryman Badge. 2. The applicant states, in effect, that he found the Permanent Orders for the Combat Infantryman Badge he was awarded by his command. 3. The applicant provided a copy of Headquarters, 3rd Brigade, 82nd Airborne Division Permanent Order Number 343-14, dated 9 December 2003; and a letter from a United States Senator, dated 25 June 2008 in support of this application. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080005152, dated 3 June 2008. 2. The applicant provided Permanent Order Number 343-14, dated 9 December 2003, which was not previously available for review. Therefore, it is considered new evidence and will be reviewed by this Board. 3. The applicant's records show he enlisted on 22 June 2001 and was trained as an indirect fire infantryman. His record shows he served in Kuwait/Iraq from 9 September 2003 through 27 September 2004 for a total of 1 year and 18 days. 4. The applicant's DD Form 214 (Certificate of Release or Discharge from Active Duty) shows that on 21 June 2005 he was honorably released from active duty and transferred to the United States Army Reserve (USAR) Control Group (Reinforcement) to complete his remaining service obligation. The applicant's record shows that he completed 4 years of total active service. 5. The applicant provided Permanent Order Number 343-14, dated 9 December 2003, which awarded the applicant the Combat Infantryman Badge for performing “satisfactorily infantry duties while engaged in active ground combat” during the period 4 October 2003 - 7 November 2003. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that he is entitled to award of the Combat Infantryman Badge for satisfactorily performing infantry duties while engaged in active ground combat while serving in Iraq. 2. Permanent Order Number 343-14, dated 9 December 2003, shows the applicant was awarded the Combat Infantryman Badge, which is not shown on his separation document. Therefore, he is entitled to correction of his records to show this award.
