IN THE CASE OF: BOARD DATE: 07 AUGUST 2008 DOCKET NUMBER: AR20080011405 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that the orders awarding him the Army Good Conduct Medal (GCMDL) (2nd Award), dated 10 December 2002 be removed from his Official Military Personnel File (OMPF). 2. The applicant states that his OMPF contains two sets of orders awarding him the second award of the GCMDL and he desires to have the latest set, dated 10 December 2002 removed from his OMPF. 3. The applicant provides copies of the two GCMDL orders in question. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 2 January 1992 for a period of 5 years and training as a military policeman. He has remained on active duty through a series of continuous reenlistments and was promoted to the pay grade of E-7 on 1 March 2004. 2. On 27 October 1997, while stationed in Italy in the pay grade of E-5, Detachment D, 510th Personnel Services Battalion Permanent Orders 300-25 was published awarding the applicant the second award of the GCMDL for the period of 2 January 1995 through 1 January 1998. 3. On 10 December 2002, while stationed at Fort Jackson, South Carolina in the pay grade of E-6, E Company, 1st Battalion, 61st Infantry Regiment Permanent Order Number 344-01 was published awarding the applicant the second award of the GCMDL for the same period of service. DISCUSSION AND CONCLUSIONS: 1. Inasmuch as there are two orders awarding the applicant the second award of the GCMDL for the same exact period, it must be presumed that an administrative error was made at the time the second set of orders were published at Fort Jackson on 10 December 2002. 2. Accordingly, it would be in the interest of justice at this time to revoke Permanent Order Number 344-01, dated 10 December 2002 and remove it from his OMPF. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by revoking E Company, 1st Battalion, 61st Infantry Regiment Permanent Order Number 344-01, dated 10 December 2002 and removing it from his OMPF. ___ XXX ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
