THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Legion of Merit. 2. The applicant states, in effect, that the award is not listed on his DD Form 214. 3. The applicant provides a copy of a DA Form 638 (Recommendation for Award) and a certificate, dated 21 August 2008, and a copy of his DD Form 214, dated 31 August 2008, in support of his request. CONSIDERATION OF EVIDENCE: 1. The applicant is a retired Regular Army master sergeant (MSG)/E-8 who entered military service on 1 December 1981, held military occupational specialty 68S (Preventive Medicine Specialist), and completed various staff and leadership positions throughout his career. He was honorably discharged on 31 August 2008 and placed on the retired list in his retired rank/grade of MSG/E-8 on 1 September 2008. 2. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 lists several awards and decorations; however, it does not show award of the Legion of Merit. 3. Headquarters U.S. Army Reserve Command, Fort McPherson, GA, Permanent Orders Number 234-006, show the applicant was awarded the Legion of Merit on 21 August 2008 for exceptionally meritorious service in positions of increased responsibility, culminating a 27-year career as a senior preventive medicine noncommissioned officer. DISCUSSION AND CONCLUSIONS: Permanent orders awarded the applicant the Legion of Merit for exceptionally meritorious service which is not shown on his DD Form 214; therefore, he is entitled to correction of his DD Form 214 to show this award.
