Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her military occupational specialty (MOS) of 88N (Traffic Management Coordinator). 2. The applicant states, in effect, that she completed training for MOS 88N but it was not listed on her DD Form 214. 3. The applicant provides copies of her DD Form 214 and a diploma from the U.S. Army Transportation School, dated 16 February 1989. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 17 September 1984. She completed her initial training and was awarded MOS 76P (Material Control and Accounting Specialist). 3. The diploma provided by the applicant shows that she attended and successfully completed the Traffic Management Coordinator Course for MOS 88N during the period 9 January 1989 to 16 February 1969. 4. Orders 83-004, issued by Headquarters, 21st Replacement Battalion, dated 23 March1989, assigned the applicant to Headquarters, 39th Transportation Corps Battalion. These orders indicate that her primary MOS at that time was 88N. 5. DA Form 2A (Personnel Qualification Record, Part I), prepared on 29 May 1992, shows that the applicant's primary MOS was 88N. 6. On 2 June 1992, the applicant was released from active duty (REFRAD) and transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete her remaining Reserve obligation. She had attained the rank/grade of specialist (SPC)/E-4, and had completed 7 years, 8 months, and 16 days of total active service. 7. Item 11 (Primary Specialty) of the applicant's DD Form 214 lists MOS of 76P, but does not include her MOS of 88N. 8. Item 14 (Military Education) of the applicant's DD Form 214 does not show completion of the Traffic Management Coordinator Course. 9. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. It stated for: * Item 11, Enter the MOS codes, titles, years, and months for warrant officers and enlisted personnel. * Item 14, list in-service training courses; title, number of weeks year successfully completed during this period of service; e.g., medical, dental, electronics, supply, administration, personnel, or heavy equipment operations. This information is to assist the member after separation in job placement and counseling; therefore, training courses for combat skills will not be listed. DISCUSSION AND CONCLUSIONS: 1. The applicant contends her DD Form 214 should be corrected to show her MOS 88N. 2. The evidence clearly shows that the applicant completed training and she was awarded MOS 88N. Furthermore, she held this MOS from 16 February 1989 to her REFRAD on 2 June 1992 for a period of 3 years and 1 month. Accordingly, this MOS should be shown on her DD Form 214. 3. Based on her successful completion of the 88N course, she is also entitled to correction of her DD Form 214 to show this course completion. Therefore, her DD Form 214 should be corrected accordingly.
