THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to his DD Form 214 (Certificate of Release or Discharge) to show his foreign service tour locations.
 
2.  The applicant states he served two tours in support of Operation Iraqi Freedom from February 2003 to February 2004 and again the following year.  He is now trying to apply for Stop Loss Pay and his DD Form 214 does not show his wartime service. 

3.  The applicant did not provide any supporting documents with his application. 

CONSIDERATION OF EVIDENCE:

1.  With prior active service in the U.S. Marine Corps, the applicant enlisted in the Regular Army on 31 August 2000 in the rank of specialist/pay grade E-4 for a 
3-year period.  He was awarded military occupational specialty 25L (Cable Systems Installer/Maintainer).

2.  Item 5 (Oversea Service) of his DA Form 2-1 (Personnel Qualification Record) shows he served in the Republic of Korea for 12 months from 31 August 2000 to on or about 23 August 2001.  

3.  The applicant was awarded the Army Commendation Medal by Permanent Order 201-880 issued on 15 August 2003 for his service in Iraq as a cable and wire systems installer from 19 March 2003 to 31 May 2003.

4.  On 4 November 2007, he was honorably separated from active duty under the provisions of Army Regulation 635-200, paragraph 5-8 for parenthood.  Item 12f (Record of Service [Foreign Service]) shows he had completed 11 months and 23 days of total foreign service.  No geographic location is identified on this DD Form 214 for his foreign service tour.

5.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows these awards:

* Army Commendation Medal
* U.S. Army and U.S. Air Force Presidential Unit Citation
* Army Good Conduct Medal (2nd Award)
* Marine Corps Good Conduct Medal
* National Defense Service Medal 
* Global War on Terrorism Expeditionary Medal (GWOTEM)
* Global War on Terrorism Service Medal (GWOTSM)
* Korea Defense Service Medal
* Army Service Ribbon
* Navy Sea Service Deployment Ribbon

6.  Item 18 (Remarks) contains no entries to show the location(s) of his deployments.  

7.  The Defense Finance and Accounting Service (DFAS) established that the applicant received hostile fire pay/imminent danger pay (HFP/IDP) as follows:

* for Kuwait from 18 February 2003 to 20 February 2004
* for Kuwait from 21 January 2005 to 18 January 2006 

8.  Army Regulation 635-5 (Separation Documents) establishes standardized policy for preparing and distributing the DD Form 214.  The regulation states that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.  Paragraph 2-4 requires the preparer to enter all awards and decorations for all periods of service from the Enlisted Record Brief and verified by the Soldier's record.  In addition, it states that for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" will be entered in item 18.



DISCUSSION AND CONCLUSIONS:

1.  Based on the evidence of record, his record should be corrected to show he served these additional foreign service tours:

* in Kuwait/Iraq from 18 February 2003 to 20 February 2004, a duration of 1 year and 3 days
* in Kuwait from 21 January 2005 to 18 January 2006, a duration of 11 months and 29 days

2.  With the additional period of foreign service added to his DD Form 214, he also is entitled to a correction of item 12f to show he served an additional 2 years, 1 month and 2 days of foreign service.  Therefore, his record should be corrected to show his total foreign service as 3 years and 12 days.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 with a separation date of 4 November 2007 to show:

	a.  in item 12f "03 YEARS 00 MONTHS 12 DAYS";

	b.  add to item 18, this entry, "SERVICE IN KUWAIT/IRAQ FROM 20030218 – 20040220; SERVICE IN KUWAIT FROM 20050121 – 20060118."
