THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests Student Loan Repayment Program (SLRP) benefits.  

2.  The applicant states he signed a National Guard Bureau (NGB) Form        600-7-5-R-E (SLRP Addendum) prior to enlisting and was under the impression he would be receiving the SLRP which was one of the reasons for his enlisting.  

3.  The applicant provides an NGB Form 600-7-5-R-E in support of his application. 

CONSIDERATION OF EVIDENCE:

1.  The applicant’s record shows he enlisted in the Army National Guard (ARNG) on 17 December 2009.  

2.  On 12 December 2009 during his enlistment processing, the applicant completed a SLRP Addendum.  This document outlined obligations and participation requirements for entitlement to the SLRP benefits and to make the terms of the agreement a matter of record.  In this document the applicant confirmed he understood it was his responsibility to provide all of his promissory notes upon his enlistment in order for them to be forwarded to the State Incentive Manager.  It further stipulates a payment will not be authorized if the applicant did not submit his promissory notes or a letter of disbursement at the time of his enlistment.  


3.  In connection with the processing of this case, an advisory opinion was obtained from the NGB, Chief, Personnel Policy Division.  This NGB official recommends disapproval of the applicant’s request.  He states the applicant signed a SLRP addendum in which he acknowledged it was his responsibility to provide loan documents at the time of his enlistment.  He further indicates the applicant’s signature on the NGB Form 600-7-5-R-E confirms he was aware of the requirements for eligibility for the program prior to his enlistment.  He concludes that the State concurred with this opinion.    

4.  On 7 November 2011, the applicant was provided a copy of the NGB advisory opinion in order to have the opportunity to respond.  To date, he has failed to reply.  

5.  NGB Form 600-7-5-R-E (SLRP Addendum) states the principle purpose of the form is to explain the obligation and participation requirements for entitlement under SLRP and to ensure the member’s agreement to the conditions is a matter of record.  In Section VI (Statement of Understanding) the applicant acknowledged he understood it was his responsibility to furnish the Military Entrance Processing Station Counselor with a copy of all of his promissory notes or letter of disbursement upon enlistment.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s request for payment of SLRP benefits has been carefully considered.  However, there is insufficient evidence to support this claim.  

2.  Under the terms of the applicant’s SLRP addendum, it was the applicant’s responsibility to provide his student loan promissory notes at the time of his enlistment.  There is no evidence of record or independent evidence provided by the applicant that shows he complied with this requirement.  As a result, there is an insufficient evidentiary basis to support granting the requested relief.
