THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his correct social security number (SSN). 2. The applicant states his SSN is incorrect. 3. The applicant provides a Social Security Administration (SSA) verification printout, dated 4 April 2011, in support of his application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 18 November 1966. The DD Form 47 (Record of Induction) prepared for his induction lists a Service Number (SN) as the primary identification number used for service members at the time. However, his record contains a DD Form 398 (Statement of Personal History) prepared during his induction processing that shows in item 13 (Employment) the same SSN as shown on the SSA printout (which begins with the number "3"). 3. The applicant’s DA Form 20 (Enlisted Qualification Record) prepared on 25 November 1966 upon his entry on active duty shows the same SSN as shown on the SSA printout. 4. All other official documents on file in the applicant’s Military Personnel Records Jacket (MPRJ) containing an SSN also show the same SSN as shown on the SSA printout. 5. The applicant was honorably released from active duty on 15 November 1968 at the expiration of his term of service. He was transferred to the U.S. Army Reserve (USAR) Control Group (Annual Training) to complete his remaining Reserve obligation. Item 3 (SSN) of the DD Form 214 he was issued at the time shows his SSN using the number "5" as the first digit. 6. Letter Orders Number 10-1418992, issued by the Office of the Adjutant General, U.S. Army Reserve Components Personnel and Administration Center, St. Louis, MO, dated 18 October 1972, honorably discharged the applicant from the USAR effective 17 November 1972. These orders show the same SSN as shown on the SSA printout. DISCUSSION AND CONCLUSIONS: 1. The applicant’s request for correction of his DD Form 214 to show his correct SSN has been carefully considered and found to have merit. 2. The evidence of record confirms the applicant listed his correct SSN on the DD Form 398 he prepared during his induction processing and that all other official documents in his record with an SSN bear the same number that he claims is correct. 3. Further, the orders directing the applicant’s final discharge from the USAR also list his SSN using the same number as shown on the SSA printout. Therefore, it appears the SSN entered in item 3 of his DD form 214 was incorrectly entered using the number “5” as the first digit as a result of an administrative error. As a result, it would be appropriate to correct item 3 of his DD Form 214 accordingly.
