IN THE CASE OF: BOARD DATE: 26 July 2012 DOCKET NUMBER: AR20120002046 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Combat Action Badge, Afghanistan Campaign Medal with one bronze service star, and the Iraq Campaign Medal with two bronze service stars. 2. The applicant states the awards were issued after his release from active duty. 3. The applicant provides: * a DD Form 214 * Permanent Orders 037-14, issued by the U.S. Army Human Resources Command (HRC), dated 6 February 2007 * a Memorandum for Record by a Retired colonel, Subject: Iraq Campaign Medal, dated 30 January 2012 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was appointed a Reserve commissioned officer on 13 January 2001. He was ordered to active duty for a period of 3 years and he entered active duty on 11 March 2001. 3. Permanent Orders 037-14, dated 6 February 2007, awarded him the Combat Action Badge for actively engaging or being engaged by the enemy on 19 May 2003. 4. He was honorably released from active duty on 10 March 2004 and he was transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his remaining service obligation. The DD Form 214 he was issued at the time shows in: a. item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the: * Bronze Star Medal * Army Commendation Medal * Army Achievement Medal * National Defense Service Medal * Army Service Ribbon b. item 18 (Remarks) the entry: * Soldier deployed in support of Operation Enduring Freedom from 19 May 2002 to 19 November 2002 and * Operation Iraqi Freedom from period 8 April 2003 to 24 November 2003 5.
