Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "XXX-XX-." 2. The applicant states the SSN shown on his DD Form 214 for the period ending 4 December 1969 is incorrect. His SSN is "XXX-XX-," not "XXX-XX-." 3. The applicant provides Renville County Veterans Service correspondence, dated 22 February 2012, and copies of his: * DD Form 214 * social security card * Medicare Health Insurance card * Blue Cross Blue Shield 3M Retiree Medical Plan card CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 29 April 1968. 3. The applicant's record contains a DD Form 47 (Record of Induction), dated 14 August 1967, showing his SSN as "XXX-XX-." 4. The applicant's record contains a DD Form 398 (Statement of Personal History), dated 17 March 1968, in which he listed his SSN as "XXX-XX-." 5. The applicant's record contains Armed Forces Examining and Entrance Station Special Orders Number 85, dated 29 April 1968, inducting him into the Army of the United States effective 29 April 1968. His SSN is listed as "XXX-XX-." 6. The applicant's record contains a DD Form 1584 (National Agency Check Request), dated 7 May 1968, showing his SSN as "XXX-XX-." 7. The applicant's record contains a variety of assignment, award, promotion, and qualification orders showing his SSN as either "XXX-XX-" or "XXX-XX-." 8. The applicant's record contains Headquarters, U.S. Army Personnel Center, Special Orders Number 337, dated 3 December 1969, releasing him from active duty effective 4 December 1969. His SSN is listed as "XXX-XX-." 9. The applicant's record contains a DA Form 20 (Enlisted Qualification Record), dated 3 May 1968 and audited on 30 November 1969, showing his SSN as "XXX-XX-." 10. The applicant was released from active duty on 4 December 1969. His DD Form 214 shows his SSN as "XXX-XX-." 11. The applicant provides a copy of his social security card showing his SSN as "XXX-XX-." 12. The applicant provides a copy of his Medicare Health Insurance card showing his Medicare claim number as "XXX-XX--A" and a copy of his Blue Cross Blue Shield 3M Retiree Medical Plan card. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that the SSN recorded on his DD Form 214 is incorrect. 2. The applicant's induction orders and orders releasing him from active duty show his SSN as "XXX-XX-" as well as a variety of assignment, award, promotion, and qualification orders. Therefore, the evidence is sufficient to correct his DD Form 214 to show his SSN as "XXX-XX-."
