THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his foreign service be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 13 March 2004. 2. The applicant states the Department of Veterans Affairs (VA) won't help him because his records do not show foreign service. 3. The applicant provides no additional evidence in support of his application. CONSIDERATION OF EVIDENCE: 1. He enlisted in the Regular Army on 14 March 2001 for a period of 3 years. 2. He was assigned to Headquarters and Headquarters Detachment, 720th Military Police Battalion on 29 August 2001. 3. His Enlisted Record Brief (ERB) does not reflect any foreign service. His official military personnel file (OMPF) does not contain any record of foreign service. 4. On 13 March 2004, he was released from active duty. He was issued a DD Form 214 for the period from 14 March 2001 to 13 March 2004. a. Item 12c (Net Active Service this Period) indicates he completed 3 years of active service. b. Item 12f (Foreign Service) does not show he had any foreign service during the period covered by the DD Form 214. c. Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 shows he was awarded or is authorized the: * Army Lapel Button * National Defense Service Medal * Army Service Ribbon 5. An email, dated 17 August 2012, from the Defense Finance and Accounting Service (DFAS) states he received hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion (CZTE) from 24 March 2003 through 28 November 2003 for Kuwait. 6. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Global War on Terrorism Expeditionary Medal is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in the Global War on Terrorism operations on or after 11 September 2001 to a date to be determined. Service members must be assigned, attached, or mobilized to a unit participating in designated operations for 30 consecutive days or 60 nonconsecutive days in the areas of eligibility (AOE), or meet other, specified criteria. Initial award of the Global War on Terrorism Expeditionary Medal was limited to service members deployed abroad in Operations Enduring Freedom and Iraqi Freedom in designated specific geographic AOE, including Kuwait.) b. Service members qualified for the Global War on Terrorism Expeditionary Medal by reason of service between 19 March 2003 and 28 February 2005, in an area for which the Iraq Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Iraq Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. No service member will be entitled to both medals for the same act, achievement, or period of service. c. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the AOE designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the Global War on Terrorism Service Medal. 7. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. a. Foreign service, taken from the ERB/ORB (enlisted record brief/officer record brief) performed during the period covered in Item 12c (Net Active Service This Period) of the DD Form 214 will be entered in item 12f. b. When an active duty Soldier is deployed with his unit during the period covered by the DD Form 214, the entry "SERVICE IN (name of country) FROM (inclusive dates in YYYY/MM/DD format) will be made in item 18 (Remarks). DISCUSSION AND CONCLUSIONS: 1. His military service records do not show any foreign service; however, the email from DFAS shows he received HF/IDP and CZTE for Kuwait. Therefore, it is appropriate to correct his DD Form 214 to show: * he had 8 months and 5 days (00 08 05) of foreign service in item 12f * include the entry "SERVICE IN KUWAIT 20030324 - 20031128" in item 18 2. Based on the above corrections, he is authorized the Global War on Terrorism Expeditionary Medal. 3. Based on his service outside the AOE for the Global War on Terrorism, Service Medal he is authorized the Global War on Terrorism Service Medal. Therefore, these two awards should be added to his DD Form 214.
