Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests a second award of the Army Good Conduct Medal. 2. The applicant states: * He only has one award of the Army Good Conduct Medal for 6 years of active duty * He served 6 years with no issues * He should have a second Army Good Conduct Medal 3. The applicant provides his DD Form 214 (Certificate of Release or Discharge from Active Duty). CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 5 November 2002 for a period of 6 years. He completed his training and was awarded military occupational specialty 25B (information technology specialist). He extended his enlistment on 17 May 2006 for a period of 2 months. He served in Kuwait/Iraq in support of Operation Iraqi Freedom from 4 February 2007 to 12 February 2008. On 4 January 2009, he was honorably released from active duty in the rank of sergeant after completing 6 years and 2 months of creditable active service with no time lost. 2. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he received the Army Good Conduct Medal. 3. Orders, dated 15 November 2005, show he received the first award of the Army Good Conduct Medal for the period 5 November 2002 to 4 November 2005. 4. There are no orders for a second award of the Army Good Conduct Medal in the available records. 5. There also is no evidence of any disciplinary or adverse actions or a commander's disqualification that would have precluded him from being awarded a second award of the Army Good Conduct Medal. 6. He received the Army Commendation Medal for meritorious service during the period 14 February 2007 to 14 April 2008. 7. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. The applicant requests a second award of the Army Good Conduct Medal. 2. Evidence shows he received the first award of the Army Good Conduct Medal for the period 5 November 2002 to 4 November 2005. 3. He was released from active duty in the rank/grade of sergeant with 6 years and 2 months of total active service with no time lost. He served in Kuwait/Iraq from 4 February 2007 to 12 February 2008, he received the Army Commendation Medal for meritorious service during the period 2007/2008, and there is no evidence of any disciplinary actions or a commander's disqualification for the second award of the Army Good Conduct Medal. It appears he met the eligibility criteria for the second award of the Army Good Conduct Medal for the period 5 November 2005 through 4 November 2008. Therefore, he is entitled to award the second award of the Army Good Conduct Medal (2nd Award) and correction of his DD Form 214 to show this award.
