Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his record be corrected to show authorization of 2 campaign stars with his Afghanistan Campaign Medal (ACM) and that he be awarded the Iraq Campaign Medal (ICM) in lieu of the Global War on Terrorism Expeditionary Medal (GWOTEM). 2. The applicant states he is authorized 2 campaign stars with the ACM because he was deployed during two campaigns. He makes no statement regarding his request to be awarded the ICM in lieu of the GWOTEM. 3. The applicant provides his 2011 DD Form 214 (Certificate of Release or Discharge from Active Duty) and mobilization orders issued in 2010 in support of his request. CONSIDERATION OF EVIDENCE: 1. The record shows the applicant enlisted in the United States Army Reserve (USAR) on 31 May 1983, and has continuously served in that status through the present. 2. On 28 May 2008, the applicant was ordered to active duty in support of Operation Enduring Freedom. He served on active duty for 11 months and 23 days until be honorably released from active duty (REFRAD) and returned to his USAR unit on 20 May 2009. 3. The DD Form 214 issued to the applicant on 20 May 2009 upon his REFRAD shows no overseas service in item 12f (Foreign Service). It also does not include the GWOTEM in the list of earned awards nor does it document a deployment to Iraq in item 18 (Remarks). 4. On 12 November 2010, the applicant was ordered to active duty in support of Operation Enduring Freedom. He served on active duty for 1 year, 1 month, and 9 days until being honorably REFRAD and returned to his USAR unit on 20 December 2011. 5. The DD Form 214 he was issued upon his REFRAD on 20 December 2011 contains an entry in item 18 confirming he was deployed to Afghanistan from 8 December 2010 to 5 November 2011. There is no record of a deployment to Iraq in item 18. The DD Form 214 does include the ACM with campaign star and GWOTEM in the list of earned awards. 6. A review of the applicant’s Defense Finance and Accounting Service (DFAS) record shows he received imminent danger pay/hostile fire pay (IDP/HFP) for Afghanistan from 5 December 2010 through 30 November 2011. There is no indication in the DFAS record that he ever received IDP/HFP for Iraq. 7. Army Regulation 600-8-22 (Military Awards) contains the Army’s awards policy. Paragraph 2-16 contains guidance on the ACM. It states a bronze service star is authorized for each campaign a member is credited with participating in while serving in Afghanistan. During the applicant’s tenure of assignment, participation credit was granted for the Consolidation III (1 December 2009-30 June 2011) and Transition I (1 July 2011-Date to be Determined) Afghanistan campaigns. 8. Paragraph 2-17 of the awards regulation contains guidance on the ICM. It states it is authorized for 30 consecutive or 60 non-consecutive days of service in the Iraq area of eligibility (AOE) during the qualifying period. It further states members qualified for the GWOTEM for service in the Iraq AOE between 19 March 2003 and 28 February 2005, for which the ICM was subsequently authorized, will remain qualified for that medal; however, upon application, any such service member may be awarded the ICM in lieu of the GWOTEM for such service. DISCUSSION AND CONCLUSIONS: 1. The applicant’s request to correct his record to show authorization of 2 campaign stars (i.e., bronze service stars) with his ACM and to be awarded the ICM in lieu of the GWOTEM has been carefully considered and found to have partial merit. 2. The evidence of record confirms campaign participation credit was granted for two campaigns during the applicant’s tenure of assignment in Afghanistan. As a result, it would be appropriate to correct his DD Form 214 accordingly. 3. The evidence of record and the independent evidence submitted by the applicant fail to show the applicant ever served in Iraq. Further, it is unclear which area of eligibility service qualified the applicant for the GWOTEM. As a result, absent any evidence that the applicant served in a qualifying AOE for the ICM, there is an insufficient evidentiary basis to support awarding the ICM in lieu of the GWOTEM. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his 2011 DD Form 214 by deleting the current Afghanistan Campaign Medal entry and replacing with the entry “Afghanistan Campaign Medal with 2 bronze service stars. 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
