THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of item 14 (Military Education) of his 
DD Form 214 (Certificate of Release or Discharge from Active Duty).  

2.  The applicant states:

* the length of time for advanced individual training (AIT) shown on his 
     DD Form 214 is 10 weeks, but it was 5-6 months
* the length of time at AIT directly results in a certain amount of college hours in his field of training
* he is currently applying to college and needs this correction for his accreditation   

3.  The applicant provides:

* Diploma
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant enlisted in the Regular Army on 22 August 2005.

3.  He provides a diploma which shows he completed the Mental Health Specialist Course.  The duration of this course was 31 October 2005 to 6 April 2006, a total of 25 weeks.   
 
4.  On 7 September 2007, he was honorably discharged by reason of physical disability with severance pay.

5.  Item 14 of his DD Form 214 shows the entry "MENTAL HEALTH SPECIALIST COURSE, 10 WEEKS, 2006//NOTHING FOLLOWS." 

6.  A review of the Army's Recruiting website (www.goarmy.com) shows job training for military occupational specialty 68X (mental health specialist) requires 10 weeks of basic combat training and 20 weeks of advanced individual training which may vary depending on specialty. 

DISCUSSION AND CONCLUSIONS:

The diploma provided by the applicant which shows he completed the 25-week Mental Health Specialist Course in 2006 is accepted as sufficient evidence on which to amend item 14 of his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the entry in item 14 of his DD Form 214 and replacing it with the entry "MENTAL HEALTH SPECIALIST COURSE, 25 WEEKS, 2006//NOTHING FOLLOWS."
