THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to add his foreign service and all awards to which he may be entitled. 2. The applicant states, in effect, his DD Form 214 did not include all of his awards or his foreign service. 3. The applicant provides: * Orders Number HO-012-0133, dated 12 January 2011 * Orders Number A-08-118300, dated 25 August 2011 * Orders Number 023-0126, dated 23 January 2013 * DD Form 214 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 30 August 2010. He held military occupational specialty 12B (Combat Engineer) and was assigned to the Engineer Company, 3rd Brigade Combat Team, 1st Cavalry Division, Fort Hood, TX. 2. Orders Number HO-012-0133, issued by Headquarters, III Corps, Fort Hood, TX, on 12 January 2011 show he was ordered to deploy, in support of Operation New Dawn, to Tallil, Iraq with a proceed date of on or about 28 January 2011. 3. Orders Number A-08-118300, issued by Landstuhl Regional Medical Center, Germany, on 25 August 2011, show he was directed to be medically evacuated to Darnall Army Medical Center, Fort Hood, TX, and attached to the Warrior Transition Brigade, Fort Hood, TX with a report date of 25 August 2011. 4. He was honorably discharged on 27 March 2013 for a combat-related medical disability after completing 2 years, 5 months, and 27 days of creditable active service and he had no lost time. His DD Form 214 shows in: * Item 12f (Foreign Service) the entry "0000-00-00" * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) the National Defense Service Medal, the Global War on Terrorism Service Medal, and the Army Service Ribbon * Item 18 (Remarks) does not show service in a combat zone 5. An email from the Defense Finance and Accounting Service (DFAS), dated 26 June 2013, shows he received hazardous fire pay/imminent danger pay and combat zone tax exclusion from 11 February 2011 to 24 August 2011 for service in Kuwait. 6. Army Regulation 600-8-22 (Military Awards) states: a. the Iraq Campaign Medal (ICM) is awarded to members who have served in direct support of OIF. The ICM period of eligibility is on or after 19 March 2003 to 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. The following approved campaigns were authorized during his period of service in Kuwait/Iraq: New Dawn (1 September 2010-31 December 2011). b. the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. 7. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. Chapter 2 establishes standardized policy for the preparation of the DD Form 214. * item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214 * item 13, enter awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 * item 18, for an active duty Soldier deployed with his/her unit during their continuous period of active service, enter "Service in (Name of Country Deployed) FROM (inclusive dates, YYYYMMDD - YYYYMMDD)" DISCUSSION AND CONCLUSIONS: 1. DFAS records show the applicant served in Kuwait from 11 February 2011 to 24 August 2011 for a total of 6 months and 14 days of foreign service. Therefore, his DD Form 214 should be corrected to show this foreign service. 2. When Soldiers deploy to Iraq their pay is processed through a finance office located in Kuwait. As a result, DFAS records frequently show Kuwait as the location the foreign service was conducted. However, the applicant’s records clearly show he deployed in support of Operation New Dawn, to Tallil, Iraq and that he was medically evacuated on 25 August 2011. Therefore, it is clear his foreign service was in Iraq and not Kuwait. 3. He participated in one campaign while serving in Iraq. Therefore, he is entitled to award of the ICM with one bronze service star and correction of his DD Form 214 show this award. 4. There is no indication his commander denied him the AGCM. He served for over 2 years and was honorably discharged due to a combat-medical condition; therefore, his DD Form 214 should be corrected to add the AGCM (1st Award) for the period 30 August 2010 through 27 March 2013.
