IN THE CASE OF: BOARD DATE: 18 February 2014 DOCKET NUMBER: AR20130010456 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) as follows: * Item 11 (Primary Specialty) – to show 4 years * Item 12b (Separation Date This Period) – to show 2 November 2012 2. The applicant states the years he served in his primary military occupational specialty (MOS) and separation date are incorrect on his DD Form 214. He believes this to be an error on his orders. 3. The applicant provides copies of Orders Number 252-0103, a DA Form 137-2 (Installation Clearance Record, and his DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the U.S. Army Reserve Delayed Entry Program (DEP) on 9 April 2008. He was discharged from the DEP on 22 April 2008. He enlisted in the Regular Army on 23 April 2008. 2. He completed basic combat training at Fort Jackson, SC. He also completed advanced individual training (AIT), the 7-week Unit Supply Specialist Course, at Fort Lee, VA, on or around 18 August 2008. He was awarded military occupational specialty (MOS) 92Y (unit supply specialist). 3. He provided a copy of a DA Form 137-2, dated 8 September 2012, which shows he completed his clearing for his expiration of term of service (ETS) of 2 November 2012. 4. Orders Number 252-0103, issued by Headquarters, III Corps and Fort Hood, TX, on 8 September 2012, ordered his reassignment to the transition point for release from active duty with an effective date of 2 November 2011. The orders list his ETS date as 2 November 2012. 5. He was honorably released from active duty and was transferred to a Reserve unit. His DD Form 214 lists in: * Item 11 – 92Y, Unit Supply Specialist, 3 years and 1 month * Item 12b – 2 November 2011 * Item 12c (Net Active Service This Period) – 3 years, 6 months, 10 days 6. On 4 February 2014, a staff member of the Defense Finance and Accounting Services verified the applicant served on active duty from 23 April 2008 through 2 November 2012. 7. Orders Number 035-0201, issued by Headquarters, III Corps and Fort Hood, TX, on 4 February 2013, amended his date of release from active duty from 2 November 2011 to 2 November 2012. 8. Army Regulation 635-5 (Separation Documents), prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. The regulation states the following: * Item 11, lists all MOSs served for at least 1 year and include for each MOS the number of years and months served; for time determination, 16 days or more count as a month, basic training and AIT are not included * Item 12b, lists the Soldier's transition date * Item 12c, lists the net service by subtracting item 12b from 12a (Date Entered Active Duty This Period) 9. Date and time calculations show the following: * the period of basic combat training from 23 April 2008 through 23 June 2008 equals 8 weeks * the period of AIT from 24 June 2008 through 18 August 2008 equals 7 weeks * the period of service from 18 August 2008 through 2 November 2012 equals 4 years, 2 months, and 16 days * the period of service from 23 April 2008 through 2 November 2012 equals 4 years, 6 months, and 10 days DISCUSSION AND CONCLUSIONS: 1. With respect to item 11 of his DD Form 214, the evidence shows he entered active duty on 23 April 2008 and completed 7 weeks of AIT for award of his MOS course on or around 18 August 2008. Therefore, he appears to have served in this MOS from approximately 18 August 2008 through 2 November 2012, a period of 4 years, 2 months, and 16 days. He is therefore entitled to correction of item 11 of his DD Form 214 to show he served in MOS 92Y for 4 years and 3 months. 2. With respect to item 12b of his DD Form 214, the evidence shows he was released from active duty on 2 November 2012. This is confirmed by his pay records and the amendments to his separation orders. Therefore, item 12b of his DD Form 214 should be corrected to show the date of 2 November 2012. 3. A correction to item 12b triggers a correction to item 12c. Item 12c credited him with 3 years, 6 months, and 10 days. However, since his separation date is now adjusted to 2 November 2012, based on this correction, item 12c of his DD Form 214 should also be corrected by crediting him with 4 years, 6 months, and 10 days of net active service.
