Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his request for correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show award of the Republic of Korea Presidential Unit Citation (ROK PUC). 2. The applicant states an error occurred in the decision made by the Army Board for Correction of Military Record (ABCMR) because it states his most significant duty assignment was the 55th Quartermaster Battalion in Korea. However, his DA Form 1314 (Certificate of Service) shows his unit was the 55th Quartermaster Base Depot. He adds they are one and the same and the unit was awarded the ROK PUC. In addition, his DD Form 214 actually shows his most significant duty assignment was the 55th Quartermaster Base Depot. He notes that he served in Korea from September 1951 to October 1952. (In his original application, the applicant also indicated that he was assigned to the 564th Quartermaster Clothing General Supplies Depot Company, a subordinate unit of the 55th Quartermaster Battalion.) 3. The applicant provides copies of his DA Form 1314 and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20120000478 on 14 June 2012. 2. The applicant's complete military record is not available to the Board for review. A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973. It is believed that the applicant's records were lost or destroyed in that fire. However, the applicant's reconstructed record that contains his DD Form 214, along with the current and previous submissions in this case, are sufficient for the Board to conduct a fair and impartial review of this case. 3. The applicant's Certificate of Service shows he served in the Army of the United States from 16 October 1950 to 10 October 1952. He attained the rank of corporal and he was assigned to the 55th Quartermaster Base Depot. 4. His DD Form 214 shows he enlisted in the Regular Army on 16 October 1950 for a period of 21 months and he was honorably released from active duty on 10 October 1952. He had completed 1 year, 11 months, and 24 days of total net service this period that included 1 year, 1 month, and 5 days of foreign service. It also shows in: a. item 3 (Grade - Rate - Rank and Date): Corporal (CPL), 16 December 1951; b. item 28 (Most Significant Duty Assignment): "55th QM BD [55th Quartermaster Base Depot] APO 59"; and c. item 27 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized): * Korean Service Medal with 2 bronze service stars * United Nations Service Medal 5. DA Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units and campaign participation of units serving in World War II and the Korean Conflict. a. It shows that Department of the Army General Orders (DAGO) cited the 55th Quartermaster Base Depot for award of the ROK PUC for the following periods: * 19 September 1950 to 31 July 1952 - DAGO Number 33 (1953) * 1 August 1952 to 30 September 1953 - DAGO Number 23 (1954) b. It also shows that the 564th Quartermaster Clothing and General Supplies Depot Company was cited for award of the ROK PUC in the same DAGOs and for the same periods, as indicated above. 6. A review of the applicant's available military records reveals he may be entitled to additional awards that are not shown on his DD Form 214. 7. A review of the applicant's available military service records failed to reveal evidence of any disciplinary actions, adverse information, or a commander's disqualification that would have precluded him from being recommended for or awarded the Army Good Conduct Medal (1st Award). 8. Army Regulation 600-65 (Service Medals), in effect at the time, stated the Army Good Conduct Medal was awarded for each 3 years of continuous enlisted active Federal military service completed on or after 27 August 1940; for first award only, 1 year served entirely during the period 7 December 1941 to 2 March 1946; and, for the first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year. A Soldier's conduct and efficiency ratings, including those pertinent to attendance at service schools, must have all been recorded as "excellent" or higher, except that ratings of "unknown" for portions of the period under consideration, and service school efficiency (emphasis in the original) ratings of less than "excellent" entered prior to 3 March 1946, would not be disqualifying. There must have been no convictions by court-martial. 9. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. a. The National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined. b. The Korean Service Medal is awarded for qualifying service in the theater of operations between 27 June 1950 and 27 July 1954. A bronze service star, based on qualifying service for each campaign listed in Appendix B of this regulation, will be worn on the service medal. c. Table B-1 contains a list of Korean War campaigns and, in part, shows the following campaigns: * United Nations Summer - Fall Offensive (9 July - 27 November 1951) * Second Korean Winter (28 November 1951 - 30 April 1952) * Korea Summer - Fall 1952 (1 May - 30 November 1952) d. The Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953. The service must have been performed, in part, while on permanent assignment or on temporary duty for 30 consecutive or 60 non-consecutive days within the territorial limits of Korea or the waters immediately adjacent thereto. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that his request for correction of his DD Form 214 to show award of the ROK PUC should be reconsidered because records show his unit was awarded the foreign unit award. 2. The evidence of record shows the applicant was released from active duty on 10 October 1952 and he was credited with 1 year, 1 month, and 5 days of foreign service. a. A calculation to determine the approximate timeframe of his service in Korea shows the following: 1952  10  10 date of separation from active duty - __01  01  05 total foreign service = 1951  09  05 latest possible arrival date in Korea b. Thus, the evidence of record supports the applicant's contention that he served in Korea from September 1951 to October 1952. 3. The evidence of record shows: a. the applicant qualified for award of the National Defense Service Medal; b. the applicant qualified for award of the Korean Service Medal and he served in three campaigns during his service in Korea. Thus, he is entitled to three bronze service stars for wear on his already-awarded Korean Service Medal; c. the applicant qualified for award of the Republic of Korea War Service Medal; and d. general orders awarded the applicant's unit the ROK PUC. 4. The applicant served a period of continuous, honorable active duty enlisted service from 16 October 1950 through 10 October 1952. a. He was promoted to CPL (E-4) with 14 months of active service. b. There is no evidence of any disciplinary actions, adverse information, or a commander's disqualification for the first award of the Army Good Conduct Medal. c. Based on the available evidence, it would be appropriate at this time to award the applicant the Army Good Conduct Medal (1st Award). 5. In view of the foregoing, it would be appropriate to correct the applicant's DD Form 214 to show his awards and decorations, as recommended below.
