THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of an earlier request for award of the: * National Defense Service Medal * Global War on Terrorism Service Medal 2. The applicant states: a. He is entitled to the National Defense Service Medal because he was not training under an inactive duty training program and he was not a part of the Individual Ready Reserve, Inactive National Guard or the Standby Retired Reserve. He also states he spent time drilling with his Maryland Army National Guard (MDARNG) unit. b. Everyone from his platoon at Fort Leonard Wood was awarded the Global War on Terrorism Service Medal prior to graduation from advanced individual training (AIT). Countless platoons and companies have been awarded this medal prior to leaving AIT or one station unit training. 3. The applicant provides no additional evidence in support of his application. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20120014228 on 19 February 2013. 2. On 27 January 2011, he enlisted in the MDARNG. He was ordered to initial active duty for training (IADT) at Fort Leonard Wood, MO, to report 14 March 2011. 3. On 26 April 2011, he was released from IADT by reason of failure to meet medical/physical/procurement standards and returned to the MDARNG. He completed 1 month and 13 days of active service that was uncharacterized. His DD Form 214 does not show any awards authorized. 4. Enclosure 3 of Department of Defense (DOD) Manual Number 1348.33 - Volume 2, subject: Manual of Military Decorations and Awards: DOD Service Awards – Campaign, Expeditionary, and Service Medals, provides eligibility requirements for DOD campaign, expeditionary, and service medals. a. Paragraph 8 states the purpose of the Global War on Terrorism Service Medal is to recognize the significant contributions members of the U.S. Armed Forces bring to bear in combating terrorism in all forms throughout the world for current and future operations. The Global War on Terrorism Service Medal is for those who serve in support of operations to combat terrorism. (1) All Service members supporting counterterrorism operations while on active duty, including reservists mobilized and National Guardsman activated on or after 11 September 2001, to a date to be determined (TBD), who meet eligibility requirements may be authorized the award. (2) Individuals authorized the award must have participated in or served in support of an approved Global War on Terrorism operation on or after 11 September 2001, and to a future date TBD. (3) Service members must have been permanently assigned, attached, or detailed to a unit that participated in or served in support of designated operations for 30 consecutive days or 60 non-consecutive days of active duty, or meet one of the following: (a) Was engaged in actual combat, regardless of time in the operation. (b) While participating in the designated operation, regardless of time, was killed, wounded, or injured requiring medical evacuation from the operation. b. Paragraph 14c(1)(a) states the National Defense Service Medal is awarded to anyone who serves on active duty in the U.S. Military during the authorized time periods. For service in the Gulf War and Global War on Terrorism, it is also authorized for Reserve Component members provided they are military reservists in good standing. This implies that a reservist must be in a drill status and also be participating in regular annual training. The National Defense Service Medal is further authorized to students at the service academies, but is NOT granted to discharged or retired veterans who did not serve during one of the time periods for which the NDSM has been authorized for award. The decoration is also NOT authorized to members of the inactive reserve. Paragraph 14c(1)(e) defines the War on Terrorism as any period between 11 September 2001 to a date TBD. DISCUSSION AND CONCLUSIONS: 1. According to the DOD Manual of Military Decorations and Awards the National Defense Service Medal is awarded to anyone who serves on active duty in the U.S. Military during the authorized time periods. The Global War on Terrorism is defined as 11 September 2001 to a date TBD. The type or length of active duty is not limited. Drilling Reservists in the Selected Reserve of the U.S. Armed Forces are also eligible. 2. The applicant served 1 month and 13 days on active duty. Therefore, he is entitled to the National Defense Service Medal. 3. The applicant was ordered to IADT. He was not mobilized or activated in support of the Global War on Terrorism. He was not permanently assigned, attached, or detailed to a unit that participated in or served in support of designated operations for 30 consecutive days or 60 non-consecutive days. Therefore, he is not eligible for the Global War on Terrorism Service Medal. 4. He contends that everyone in his platoon was awarded the Global War on Terrorism Service Medal prior to graduation from AIT. The ABCMR makes determinations based on regulations and/or law in effect at the time. Each case is determined on an individual basis. The ABCMR does not address policy practiced by individual commands in the issuance of awards. The Board determined that the evidence presented was sufficient to warrant partial amendment of the ABCMR’s decision in Docket Number AR20120014228, dated 19 February 2013. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the National Defense Service Medal to his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 26 April 2011. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
