Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests an upgrade of his discharge under other than honorable conditions to honorable. 2. The applicant states: * he had family problems as his father was in bad medical condition * his father died at age 85 and he was trying to get emergency leave * he would like to have his discharge upgraded to honorable so he can receive medical treatment 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve (Delayed Entry Program) on 26 November 1979. He enlisted in the Regular Army for 4 years on 8 January 1980. He was awarded an armor military occupational specialty (MOS). 3. On 27 April 1981, the applicant was notified that charges were pending against him for being absent without leave (AWOL) from 17 January 1980 until on or about 26 April 1981. 3. The applicant consulted with counsel. Following consultation with counsel, he submitted a voluntary written request for discharge for the good of the service in lieu of trial by court-martial under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), chapter 10. 4. In his request for discharge he indicated he understood that by requesting discharge, he was admitting guilt to the charge against him or of a lesser-included offense that also authorized the imposition of a discharge under other than honorable conditions. He acknowledged he understood that if his discharge request were approved, he could be deprived of many or all Army benefits, he could be ineligible for many or all benefits administered by the Veterans Administration, and he could be deprived of his rights and benefits as a veteran under both Federal and State laws. 5. The applicant elected to submit a statement in his own behalf wherein he stated: * the reason he joined the Army was because his father had a stroke and had doctor bills of several thousand dollars * his MOS was armor specialist and he was supposed to receive a $3,000.00 bonus to help pay doctor's bills * due to his father being paralyzed from the waist down, his mother could not bathe him or take him to the doctor for his medicine and regular checkups * he was needed more at home than in the Army 6. The appropriate separation authority approved the request for discharge on 18 May 1981 and directed the issuance of a discharge under other than honorable conditions and reduction to the lowest enlisted rank. 7. On 8 June 1981, the applicant was discharged under other than honorable conditions for the good of the service in lieu of trial by court-martial under the provisions of Army Regulation 635-200, chapter 10. He completed 1 month and 22 days of net active service during this period. 8. There is no evidence the applicant applied to the Army Discharge Review Board for an upgrade of his discharge within that board's 15-year statute of limitations. 9. Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. a. Chapter 10 provides that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate. b. Paragraph 3-7a states that an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law. The honorable characterization is appropriate when the quality of the member's service generally has met the standards of acceptable conduct and performance of duty for Army personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate. c. Paragraph 3-7b states that a general discharge is a separation from the Army under honorable conditions. When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge. DISCUSSION AND CONCLUSIONS: 1. The applicant's contentions have been noted. 2. His records show he was charged with the commission of an offense punishable under the Uniform Code of Military Justice with a punitive discharge. He voluntarily requested discharge under the provisions of chapter 10 of Army Regulation 635-200 to avoid a trial by court-martial which may have resulted in a felony conviction. 3. The evidence shows the applicant was properly and equitably discharged in accordance with the regulations in effect at the time. There is no evidence of procedural errors which would have jeopardized his rights. All requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. 4. The Army does not currently have nor has it ever had a policy that provides for discharge upgrades solely for the purpose of qualifying an applicant for veterans' medical benefits. Each case is decided on its own merits when an applicant requests a change in discharge. Changes may be warranted if the Board determines that the characterization of service or the reason for discharge, or both, were improper or inequitable. There is no evidence of record and the applicant did not provide any evidence that suggests there was any error or injustice related to his separation processing. 5. In view of the foregoing, there is an insufficient evidentiary basis for granting the applicant an honorable or a general discharge.
