THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that the Meritorious Unit Commendation (MUC) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states he was assigned to the 549th Quartermaster Company. The unit was awarded the MUC; however, at the time he was being medically discharged and it was not added to his DD 214. 3. The applicant provides: * U.S. Uniformed Services Identification Card * Permanent Orders 361-09, dated 27 December 2011, published by the U.S. Army Human Resources Command (HRC) * DD Form 214 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 9 February 2010. He completed training and was awarded military occupational specialty 88M (Motor Transportation Operator). 2. Orders CR-049-0002, dated 18 February 2011, published by Headquarters, 4th Infantry Division and Fort Carson, CO, show the applicant was deployed to Iraq in support of Operation New Dawn (OND). The orders show he was assigned to the 549th Quartermaster Company. 3. Permanent Orders 361-09, dated 27 December 2011, published by HRC, show the 549th Quartermaster Company was awarded the MUC for the period 3 April 2011 through 5 November 2011 while deployed in support of OND. 4. On 3 June 2012, the applicant was honorably retired for permanent disability in the rank of specialist (SPC)/E-4 after completing 2 years, 3 months, and 25 days of creditable active service with no time lost. 5. The applicant's DD Form 214 shows he was awarded the: * Army Commendation Medal * Army Achievement Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Iraq Campaign medal with one bronze service star * Army Service Ribbon * Overseas Service Ribbon * Certificate of Achievement 6. Item 18 (Remarks) of his DD Form 214 shows he served in Iraq from 2 April 2011 through 1 August 2011 and he completed his first term of service. 7. His record does not contain any adverse information that would have precluded him from being recommended for or awarded the first award of the Army Good Conduct Medal (AGCM). There is also no evidence the applicant was disqualified by his chain of command from receiving this award. 8. Army Regulation 600-8-22 (Military Awards) provides that the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the AGCM, disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. Evidence of record shows the 549th Quartermaster Company was awarded the MUC for the period 3 April 2011 through 5 November 2011 while deployed in support of OND. He served with the unit during this period. Therefore, his DD Form 214 should be amended by adding the MUC. 2. The applicant was honorably retired by reason of permanent disability in the rank of SPC with 2 years, 3 months, and 25 days of creditable active service with no time lost. It appears the applicant met the eligibility criteria for award of the AGCM (1st Award) for the period 9 February 2010 through 3 June 2012 on completion of a period of qualifying service. Therefore, it would be appropriate at this time to award him the AGCM (1st Award) for the period 9 February 2010 through 3 June 2012 and to correct his DD Form 214 to show this award.
