THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the Physical Security Supervisor Course be added to his DD Form 214 (Report of Separation from Active Duty) with an effective date of 22 May 1969. 2. The applicant states he completed this course from 29 January to 9 February 1968. This course should have been added to his DD Form 214. 3. The applicant provides: * DD Form 214 * certificate for completion of the Physical Security Supervisor Course * his military police background CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 21 June 1965, he enlisted in the Regular Army. He completed basic combat and advanced individual training and was awarded military occupational specialty 95B (Military Policeman). 3. On 10 August 1966, he was assigned to the 28th Military Police Detachment, U.S. Army Europe (USAREUR). He was promoted to sergeant on 18 January 1968 and to staff sergeant on 25 February 1969. 4. Item 27 (Military Education) of his DA Form 20 (Enlisted Qualification Record) shows he completed the Physical Security Course, MP 26-OEC-4, in USAREUR. The course length is shown as 2 weeks and he completed the course in 1968. 5. The certificate of completion he provided certifies he successfully completed the Physical Security Supervisor Course, MP 26-OEC-4, during the period 29 January - 9 February 1968 at the U.S. Army School, Europe. 6. On 22 May 1969, he was released from active duty. Item 25 (Education and Training Completed) of his DD Form 214 does not show he completed the Physical Security Supervisor Course. 7. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. It states for item 25, enter installation training courses (qualification courses), military correspondence courses, and off-duty courses the enlisted person has completed successfully during the period covered by the DD Form 214 being prepared. The current regulation states the entry is to include the title, length in weeks, and the year completed. DISCUSSION AND CONCLUSIONS: His DA Form 20 and the certificate he provided show he completed the 2-week Physical Security Supervisor Course on 9 February 1968 in USAREUR. Therefore, this course should be added to item 25 of his DD Form 214 to include the information as provided by the current regulation.
