IN THE CASE OF: DOCKET NUMBER: AR20130017544 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the active duty entry date shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states his initial orders were not in his available separation package. He actually entered active duty on 2 January 2010. 3. The applicant provides copies of U.S. Army Human Resources Command (AHRC) Orders A-12-932512 dated 3 December 2009 and his DD Form 214 for the period ending 30 September 2012. CONSIDERATION OF EVIDENCE: 1. HRC Orders A-12-932512, dated 3 December 2009, show the applicant was ordered to 365 days of active duty, in pay grade E-8. These orders show a report date of 2 January 2010 and an end date of 1 January 2011. 2. His DD Form 214 ending 30 September 2012 shows he entered active duty on 2 January 2011 in accordance with HRC order A-12-126738, dated 2011, as amended. 3. HRC order A-12-126738 are not contained in the applicant's interactive Personnel Electronic Records Management System record, but two amendments are available. Both only amended the end date. Orders A-12-126738A01, dated 7 September 2012, show his end date was changed to 30 September 2012 which is consistent with the end date on his DD Form 214. 4. However, the applicant's Army Reserve Retirement Points accounting page in HRC's Interactive Web Service and his AHRC Form 249-E (Chronological Statement of Retirement Point) both show that he was on continuous active duty from 2 January 2010 to 30 September 2012. DISCUSSION AND CONCLUSIONS: 1. The available evidence clearly supports the applicant's contention that he entered active duty on 2 January 2010 and served continuously until 30 September 2012. 2. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.
