Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his previous request to correct his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show award of the Bronze Star Medal and two bronze service stars with his Korean Service Medal. 2. The applicant states, in effect, these awards were not listed on his DD Form 214. 3. The applicant provides: * DD Form 214 * Headquarters, 3d Infantry Division, General Orders (GO) Number 388, dated 9 September 1953 * Bronze Star Medal Citation * Headquarters, 3d Medical Battalion, 3d Infantry Division, letter of commendation, dated 15 January 1954 * Letter to the National Personnel Records Center, dated 18 March 2002 * Army Board for Correction of Military Records (ABCMR) Docket Number AR2003092760, dated 16 March 2004 * letter from the National Archives and Records Administration, dated 10 September 2013 * two letters from his Member of Congress, dated 12 August 2013 and 18 September 2013 CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR2003092760 on 16 March 2004. 2. The applicant provided new evidence which was not previously considered and, therefore, warrants consideration by the Board. 3. The applicant's complete military records are not available to the Board for review. A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973. It is believed that the applicant's records were lost or destroyed in that fire. However, there were sufficient documents remaining in a reconstructed record for the Board to conduct a fair and impartial review of this case. 4. The applicant enlisted in the Regular Army on 21 December 1948 and he reenlisted on 21 December 1951. 5. The applicant provided Headquarters, 3d Infantry Division, GO Number 388, dated 9 September 1953, awarding him the Bronze Star Medal for meritorious service during the period 1 March 1953 to 9 September 1953 while assigned to Headquarters and Headquarters Company, 3d Medical Battalion, 3d Infantry Division, Korea. 6. His records contain his citation for award of the Bronze Star Medal for meritorious service during the period 1 March 1953 to 9 September 1953 issued by Headquarters, 3d Infantry Division. 7. He was honorably discharged on 20 December 1954. His DD Form 214 and subsequently-issued DD Form 215 (Correction to DD Form 214) show: a. He completed 1 year, 6 months, and 14 days of foreign service; however, the dates and location of that service were not listed. b. He was awarded or authorized the: * Army Good Conduct Medal (2nd Award) * Korean Service Medal * National Defense Service Medal * United Nations Service Medal 8. Army Regulation 600-8-22 (Military Awards) provides for award of the Korean Service Medal. The Korean Service Medal was awarded for service in the theater of operations between 27 June 1950 and 27 July 1954. A bronze service star is authorized with the Korean Service Medal for each campaign a Soldier is credited with participating in. Appendix B shows that during his service in the Republic of Korea, participation credit was awarded for the following two campaigns: * Third Korean Winter (1 December 1952-30 April 1953) * Korea Summer 1953 (1 May-27 July 1953) 9. Army Regulation 600-8-22 states the Republic of Korea War Service Medal was awarded to members of the U.S. Armed Forces who served in the Republic of Korea and adjacent waters between 25 June 1950 and 27 July 1954. The service prescribed must have been performed as follows: (1) while on permanent assignment; (2) while on temporary duty within the territorial limits of the Republic of Korea or on waters immediately adjacent thereto for 30 consecutive or 60 nonconsecutive days; or (3) while as crew members of aircraft in aerial flight over the Republic of Korea, participating in actual combat operations or in support of combat operations. 10. Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units during World War II and the Korean War. This pamphlet shows the 3d Medical Battalion, 3d Infantry Division, was cited for award of the: * Meritorious Unit Commendation for the period 1 January 1953 to 27 July 1953 in Department of the Army GO Number 22, dated 1954 * Bravery Gold Medal of Greece for the period of the Korean War in Department of the Army GO Number 2, dated 1956 DISCUSSION AND CONCLUSIONS: 1. GO awarded the applicant the Bronze Star Medal. Therefore, he is entitled to correction of his DD Form 214 to show this award. 2. The evidence of record shows he participated in two campaigns while serving in Korea. Therefore, he is entitled to correction of his DD Form 214 to show two bronze service stars with his previously-awarded Korean Service Medal. 3. He completed a qualifying period of service for award of the Republic of Korea War Service Medal. Therefore, he is authorized award of the Republic of Korea War Service Medal and correction of his DD Form 214 to show this award. 4. GO awarded his unit of assignment in Korea the Meritorious Unit Commendation and Bravery Gold Medal of Greece. These awards are not shown on his DD Form 214. Therefore, he is entitled to correction of his DD Form 214 to show these unit awards.
