THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 27 May 2013 to show in: * block 11 (Primary Specialty) – his military occupational specialty (MOS) code as 91B4O (Light Wheel Vehicle Mechanic) instead of 91B3O, and 25U4O (Signal Support Systems Specialist) 22 years 6 months instead of 25U3O 35 years 7 months * block 12a (Date Entered Active Duty This Period) – the entry "2004 06 01" * block 18 (Remarks) – the entries "CONTINUOUS HONORABLE ACTIVE DUTY SERVICE: 20040601-20130527" and "RETIRED LIST GRADE: SFC (sergeant first class)" 2. The applicant states he is providing the documentation needed to support the corrections to his DD Form 214. 3. The applicant provides: * DD Form 214 for the period ending 2 August 1980 * DD Form 214 for the period ending 2 October 2003 * DD Form 214 for the period ending 27 May 2013 * ARPC Form 249-E (Chronological Statement of Retirement Points) * retirement orders with amendments * active duty orders with amendments CONSIDERATION OF EVIDENCE: 1. The applicant served in the Regular Army from 3 August 1977 to 2 August 1980. His DD Form 214 for this period shows he served in MOS 36K (Tactical Wire Operations Specialist). 2. His ARPC Form 249-E shows he was a member of the U.S. Army Reserve (USAR) from 3 August 1980 to 19 May 1982. 3. His Official Military Personnel File (OMPF) contains a National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) that shows he served in the Army National Guard (ARNG) from 20 May 1982 to 19 May 1989. It further shows he served in MOS 31V (Tactical Communications Operator/Mechanic) and that he was awarded MOS 31V on 12 March 1982. 4. After a break in service, he enlisted in the USAR on 10 July 2001 for training in MOS 63B (Light Wheel Vehicle Mechanic). 5. Orders issued by Headquarters, 87th Division, Birmingham, AL on 1 July 2002, as amended, awarded him MOS 63B as his primary MOS (PMOS) and MOS 31U (Signal Support Systems Specialist) as his secondary MOS (SMOS). 6. He served on active duty in support of Operation Noble Eagle from 27 January 2003 to 2 October 2003. His DD Form 214 for this period shows he served in MOS 63B. 7. Orders issued by Headquarters, 87th Division on 27 May 2004 ordered him to active duty with a report date of 1 June 2004. The U.S. Army Human Resources Command (HRC) Integrated Web Services (IWS) database confirms he entered active duty on 1 June 2004. 8. He continued his service on active duty until 28 May 2013, when he was placed on the Retired List. His retirement orders, as amended, show he was retired in the rank of SFC. 9. His DD Form 214 for this period of service shows in: * block 11 – the entries "91B3O 10 years 11 months" and "25U3O 35 years 7 months" * block 12a – the entry "2003 01 24" * block 12c (Net Active Service This Period) – the entry "0008 11 27" * block 18 – the entries "CONTINUOUS HONORABLE ACTIVE DUTY SERVICE: 20030527-20130527" and "RETIRED LIST GRADE SSG (staff sergeant)" 10. His Enlisted Record Brief (ERB), dated 13 November 2012, shows his PMOS as 91B and his SMOS as 25U. 11. Army Regulation 635-5 (Separations Documents), in effect at the time of the applicant's placement on the Retired List, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated: a. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. b. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. c. In block 11, from the ERB, enter titles of all MOSs served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. For an enlisted Soldier, also specify the first 5 characters of the primary MOS, which includes the 3 characters of the MOS, the fourth character of skill and grade level in the MOS, and fifth character of a special qualification identifier. Enter "O" when not applicable. d. In block 12a, enter the beginning date of the continuous period of active duty for issuance of this DD Form 214, for which a DD Form 214 was not previously issued. e. In block 12c, enter amount of service this period, computed by subtracting item 12a from 12b (Separation Date This Period). 12. The Army G1, Personnel Authorization Module (PAMXXI), which is located on the Army G1 portal, is the force structure portal for the Army. This document provides information on force structure, unit manning, Army demographics and MOS charts with conversion data. It shows MOS 31V was converted to MOS 31U, effective 1 April 1993. It further shows MOS 31U was converted to MOS 25U, effective 1 January 2005 and that MOS 63B was converted to MOS 91B, effective 1 October 2009. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows he entered active duty on 1 June 2004; however, his DD Form 214 for the period ending 27 May 2013 indicates he entered active duty on 24 January 2003. Therefore, block 12a of the DD Form 214 should be corrected to show he entered active duty on 1 June 2004. The period of service shown in block 12c is correct, so no adjustment is necessary. Additionally, block 18 of the DD Form 214 should be corrected to show the beginning of his continuous honorable service as 1 June 2004. 2. Evidence also shows he was retired in the rank of SFC. Therefore, his DD Form 214 should be corrected to show his PMOS as 91B4O and to show his SMOS as 25U4O. Additionally, block 18 of his DD Form 214 should be further corrected to reflect his correct retired rank. 3. The evidence shows the applicant was ordered to active duty as a member of the USAR and that he entered active duty on 1 June 2004. Evidence also shows he held MOS 91B as his PMOS and MOS 25U as his secondary MOS through 27 May 2013 (8 years, 11 months, and 27 days) at which time he was placed on the retired list. 4. Army policy provides that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It also provides that block 11 of the form will show each MOS served or held during the period covered by the DD Form 214 in terms of the number of years and months. Therefore, in view of the fact that the DD Form 214 in question only covers 8 years, 11 months, and 27 days of active duty service, the correct entry that should have been entered in block 11 of his DD Form 214 is "91B4O WHEELED VEHICLE MECHANIC - 9 YRS//25U4O SIGNAL SUPPORT SYSTEMS SPECIALIST - 9 YRS//." 5. Based on the above, it appears that an administrative error was made in the preparation of his DD Form 214 for the period ending 27 May 2013. However, it has long been an unwritten policy of the Board that an applicant will not be made worse off than when they applied to the Board. For this reason, the Board will not take action to affect the administrative change to correct block 11 of his DD Form 214. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. correcting block 11 of his DD Form 214 to show the entries "91B4O" and "25U4O"; b. deleting the current entry in block 12a of his DD Form 214 and replacing it with the entry "2004 06 01"; and c. correcting block 18 of his DD Form 214 by replacing the entry "CONTINUOUS HONORABLE ACTIVE SERVICE: 20030527 - 20130527" with the entry "CONTINUOUS HONORABLE ACTIVE SERVICE: 20040601 - 20130527" and to show his retired list grade as "SFC." 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
