Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests payment of special pay as a Reserve Component Nurse Practitioner during her period of mobilization from 27 April 2009 through 4 February 2012. 2. The applicant states she held area of concentration (AOC) 66P (Nurse Practitioner) from 27 April 2009 to 4 February 2012. She was told by her unit finance officer that she did not qualify for the special pay. In February 2012, she found out that she was authorized to receive the pay. This was brought to the attention of the unit administrator but the issue has not been resolved. She was and remains a credentialed medical provider. 3. The applicant provides multiple orders to active duty CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a Reserve commissioned officer of the Army and executed an oath of office on 30 September 1992. She served in a variety of assignments and she was promoted to lieutenant colonel (LTC). 2. She was ordered to active duty in support of Operation Enduring Freedom on 27 April 2009. She was honorably released from active duty on 21 January 2014. 3. An advisory opinion was received on 25 February 2014 from the Chief, Army Medical Department Special Pay Branch, Office of the Surgeon General (OTSG), in the processing of this case. The advisory official states: a. The officer is requesting payment of special pays as a Reserve Component Nurse Practitioner (AOC 66P) during her period of mobilization from 20090427-20120204. b. Based on requests and documents submitted by the officer or unit for Health Professions Officer (HPO) special pay during her mobilization, this office is limited to determining authorizations as received. Authorizations from this office are forwarded to the Reserve Component Defense Finance and Accounting Service - Indianapolis Center, the responsible agent for disbursing payment of HPO special pay during mobilization. Special pays are paid retroactive to mobilization date after completion of 30 consecutive days of active duty. c. A review of available special pay data indicates the officer was authorized both the specialty Registered Nurse Incentive Special Pay (RNISP) at $5,000/year; payable prorated monthly, and the Non-Physician Board Certification Pay (NPBCP) at $2,000/year; payable prorated monthly. This office initiated both the RNlSP and NPBCP for the mobilized tour period 20120204-20140202. There are no other records available indicating authorizations or payment of the RNISP or NPBCP during the requested period. d. The officer was eligible to receive the RNISP at $5,000/year and NPBCP at $2,000/year, payable prorated for the period 20090427-20120203. 4. The applicant was provided with a copy of this advisory opinion. She concurred via email on 10 March 2014. DISCUSSION AND CONCLUSIONS: 1. A review by OTSG of available special pay data indicates the applicant was authorized both the specialty RNISP at $5,000/year, payable prorated monthly, and the NPBCP at $2,000/year, payable prorated monthly. There are no other records available indicating authorizations or payment of the RNISP or NPBCP during the requested period. 2. The applicant was mobilized on 27 April 2009 and she was demobilized on 21 January 2014. OTSG has initiated both the RNlSP and NPBCP for the mobilized tour period 20120204-20140202. That leaves the period 27 April 2009 through 3 February 2012 unpaid. 3. Therefore, the applicant is entitled to both authorization and payment of the RNISP and/or NPBCP for the mobilized tour period 20090427 - 20120203.
