THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he was awarded the Army Good Conduct Medal. 2. The applicant states the award is not listed on his DD Form 214. 3. The applicant did not provide any supporting documentation. CONSIDERATION OF EVIDENCE: 1. Following prior service in the U.S. Marine Corps, the applicant enlisted in the Regular Army on 1 September 2009. He held military occupational specialty 11B (Infantryman). 2. His Enlisted Record Brief (ERB) shows his awards as the Army Commendation Medal, Presidential Unit Citation (Navy), National Defense Service Medal, Afghanistan Campaign Medal, Iraq Campaign Medal, Global War on Terrorism Expeditionary Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Naval Sea Service Deployment Ribbon, NATO Medal, and the Combat Infantryman Badge. 3. He was honorably discharged effective 31 August 2012 as a specialist (SPC)/E-4. He had completed 3 years of active duty service during the period covered by his DD Form 214 with no time lost listed. His DD Form 214 and subsequent DD Form 215 (Correction to DD Form 214) list his authorized awards as the Army Commendation Medal, Presidential Unit Citation (Navy), National Defense Service Medal, Afghanistan Campaign Medal with two bronze service stars, Global War on Terrorism Expeditionary Medal, Global War on Terrorism Service Medal, Iraq Campaign Medal with one bronze service star, Army Service Ribbon, Overseas Service Ribbon, Naval Sea Service Deployment Ribbon (2 Awards), NATO Medal, Combat Infantryman Badge, and Purple Heart. 4. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. The following period of continuous enlisted active Federal military service qualifies for award: For first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year. DISCUSSION AND CONCLUSIONS: 1. The applicant’s records show he distinguished himself in the performance of his military service as evidenced by him attaining the rank of SPC and receiving personal decorations. Furthermore, there is no evidence of any misconduct or disciplinary action or a commander's disqualification for award of the Army Good Conduct Medal. It is presumed that he did not receive the Army Good Conduct Medal due to an oversight. Accordingly, he should be awarded the Army Good Conduct Medal (1st Award) for the period 1 September 2009 to 31 August 2012. 2. Therefore, his DD Form 214 should be corrected to show this award.
