Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of his Enlisted Record Brief (ERB) from his Army Military Human Resource Record (AMHRR). 2. He states his ERB is blank and U.S. Army Reserve (USAR) Soldiers do not use the ERB but use the DA Form 2-1 (Personnel Qualification Record – Part II) instead. He states a current copy of his DA Form 2-1 is already filed in his AMHRR. 3. He provides his ERB, dated 21 January 2014. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the USAR on 17 July 2001. He is currently serving as a staff sergeant with the 9th Legal Operations Detachment, Whitehall, OH. 2. A copy of his ERB, dated 21 January 2014, is filed in his AMHRR. With the exception of his name, rank, social security number, component, and a few entries under Section II (Service Data), the rest of the fields on his ERB are blank. 3. A completed DA Form 2-1 is also filed in his AMHRR. 4. Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the AMHRR. This regulation states that only the most current ERB will be filed as part of a mobilization packet, and only the last ERB produced before separation or a change in component in the service section of the AMHRR. DISCUSSION AND CONCLUSIONS: While the regulation does require filing of the ERB even for Reserve Soldiers in the AMHRR, based on the fact that his ERB is incomplete it does not do him or the Army any good to retain this document in his AMHRR. Therefore, it would be appropriate to remove this document from his AMHRR.
