THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show her deployment to the Multinational Force and Observers (MFO) peacekeeping mission in Sinai-Egypt during the period August 1983 – February 1984 and the award she received for that deployment. 2. The applicant states she deployed to the Multinational Force and Observers (MFO) peacekeeping mission in Sinai-Egypt during the period August 1983 – February 1984 and received a ribbon for that deployment. However, neither the deployment or the ribbon are reflected on her DD Form 214. She needs her records corrected to support a claim of Post-Traumatic Stress Disorder (PTSD). 3. The applicant provides a copy of her DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 28 July 1982. She completed her training and was transferred to Fort Lewis, WA for her first assignment. 3. She deployed to the MFO peacekeeping mission in Sinai-Egypt during the period August 1983 – February 1984. 4. She was transferred to Germany on 24 June 1984 and remained there until she was honorably released from active duty (REFRAD) on 23 May 1986 under the Fiscal Year 1986 Early Release Program. Her DD Form 214 issued at the time of her REFRAD shows she was awarded the Army Good Conduct Medal, Army Service Ribbon, Army Achievement Medal, and the Overseas Service Ribbon. 5. Army Regulation 600-8-22 (Military Awards) states the Multinational Force and Observers Medal was accepted by the President for the U.S. Armed Forces on 28 July 1982. To qualify for the award, personnel must have served with the Multinational Force and Observers at least 90 days cumulative after 3 August 1981. Periods of service on behalf of the Multinational Force and Observers outside of the Sinai and periods of leave while a member is serving with the Multinational Force and Observers may be counted toward eligibility for the Multinational Force and Observers Medal. 6. Army Regulation 635-5 at the time served as the authority for the preparation of the DD Form 214. It did not provide for adding deployments to the DD Form 214. However, the current regulation provides, in pertinent part, that for an active duty Soldier deployed with his or her unit during their continuous period of active service, the following entry will be made in item 18 (Remarks): "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. The applicant served during a qualifying period for award of the MFO Medal. Accordingly, it should be added to her DD Form 214. 2. Although the regulation in effect at the time did not provide for adding deployments to the DD Form 214, the current regulation does. Therefore, as a matter of equity the applicant’s deployment in support of the MFO in Sinai – Egypt during the period August 1983 – February 1984 should be added to her DD Form 214.
