THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the last four numbers of his social security number (SSN) as 7XXX.

2.  The applicant states his DD Form 214 shows the last four numbers of his SSN as 2XXX instead of 7XXX.

3.  The applicant provides copies of:

* DD Form 214 
* Social Security Card showing the last four numbers as 7XXX

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2.  On 29 September 1961, the applicant was inducted into the Army of the United States (AUS).  He was issued a service number which was used as his primary identification number.  The U.S. Army made limited use of SSNs at the time.

3.  A review of the applicant’s military records failed to show any document using a SSN as ending in 7XXX.  The following documents show he used an SSN ending in 2XXX:

* DA Form 41 (Record of Emergency Data) dated 3 August 1963
* DA Form 24 (Service Record) dated 27 September 1963

4.  On 27 September 1963, the applicant was released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training).  His 
DD Form 214 shows in Item 32 (Remarks) his SSN as ending in 2XXX.

5.  Army Regulation 635-5 (Separation Documents) as then in effect, required the SSN to be entered in Item 32 of the DD Form 214.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show the last four numbers of his SSN as 7XXX.

2.  The evidence of record clearly shows that the applicant was inducted into the AUS and issued a service number.  When required, he used an SSN ending in 2XXX which is shown on those military documents requiring this information.

3.  There is no evidence showing that the applicant, while in the AUS, ever used the SSN he now claims to be correct.

4.  The Army has an interest in maintaining the accuracy of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.

5.  The applicant is advised that a copy of this decisional document will be filed in his military records.  This should serve to clarify any questions or confusion in regard to the difference in his current SSN and the one recorded in his military record, and to satisfy his desire to have his current SSN documented in his record.

6.  In view of the above, the applicant’s request should be denied.
