Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests retroactive payment of Health Professions Officer Incentive Pay (HPOIP) for the period 31 August 2011 through 30 September 2012. 2. The applicant states, in effect, that she received her HPOIP for 2010 but did not receive it for 2011 and 2012. She goes on to state that she made applications and for reasons that are not apparent her requests were not processed as she did not receive her payments which amount to $2,500 per year for a total of $5,000 back pay owed her. She also states that when she checked into why she was not paid, she was informed that she had to apply to the Board. 3. The applicant provides a list of enclosures as page 5 of her application. CONSIDERATION OF EVIDENCE: 1. The applicant was commissioned as a Regular Army Veterinary Corps captain on 17 May 2010 with a concurrent call to active duty. She completed her training and was assigned to Moody Air Force Base, Florida. 2. In the processing of this case a staff advisory opinion was obtained from the Office of the Surgeon General (OTSG) Special Pay Branch which states the applicant received HPOIP ($2,500) for the period 23 June 2010 through 22 June 2011. The next 1-year HPOIP contract at $5,000/year is effective 22 June 2011. However, there are no records of HPOIP contracts for the period effective 23 June 2011 or 23 June 2012, a period in which she was eligible to receive $2,500.00 per year payable at $208.33 per month. The advisory opinion was provided to the applicant for comment. To date, no response has been received by the Board staff. DISCUSSION AND CONCLUSIONS: 1. Although the applicant has not provided copies of her applications for HPOIP for the period 23 June 2011 through 22 June 2013, she performed the duties of veterinarian and was eligible to receive the pay. 2. Additionally, the advisory opinion from OTSG states she was eligible to receive $2,500.00 per year payable at $208.33 per month for the period 23 June 2011 through 22 June 2013. 3. Therefore, as a matter of equity, the applicant’s record should be corrected to show she submitted her contracts to OTSG for HPOIP for the period 23 June 2011 through 22 June 2013 in a timely manner. 4. Accordingly, OTSG should accept and authorize retroactive payments of HPOIP for the period 23 June 2011 through 22 June 2013.
