THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Medical Badge (CMB) and other awards or ribbons for his service in support of Operation Iraqi Freedom (OIF). 2. He states that due to stop loss he returned to base before his unit returned from Iraq (OIF). He wore the CMB, but it wasn't recorded on his DD Form 214 upon his discharge. All of the medics from the 2nd Battalion, 325th Airborne Infantry Regiment received the CMB during the initial invasion. 3. He provides no additional documents. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 19 May 1999. He completed basic combat and advanced individual training and he was awarded military occupational specialty (MOS) 91W (Health Care Specialist). 2. His DD Form 214 shows he served in Iraq from 15 March to 22 August 2003 in support of OIF. 3. His service record does not contain orders awarding him the CMB or evidence indicating his unit commander recommended him for this badge. 4. He was honorably released from active duty on 30 November 2003. His DD Form 214 shows he was assigned to Headquarters and Headquarters Company, 2nd Battalion, 325th Infantry Regiment at the time of separation. 5. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized (All periods of service)) of his DD Form 214 shows award of the Army Commendation Medal (2nd Award), Army Good Conduct Medal, National Defense Service Medal, Army Service Ribbon, Expert Marksmanship Qualification Badge with Rifle Bar, and Parachutist Badge. 6. His record does not contain any evidence showing he was actively engaged in ground combat while assigned or attached to a medical unit of company or smaller size that was organic to an infantry unit of brigade, regimental, or smaller size which was engaged in active ground combat. 7. Army Regulation 600-8-22 (Military Awards) states medical personnel assigned or attached to or under operational control of any combat arms unit of brigade or smaller size on or after 18 September 2001 who satisfactorily perform medical duties while the unit is engaged in active ground combat are eligible for award of the CMB, provided they are personally present and under fire. 8. Army Regulation 600-8-22 states the Iraq Campaign Medal is awarded to members who have served in direct support of OIF. The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved campaigns include: * Liberation of Iraq (19 March 2003-1 May 2003) * Transition of Iraq (2 May 2003-28 June 2004) 9. Army Regulation 600-8-22 states the Global War on Terrorism Service Medal (GWOTSM) is authorized for award to members of the Armed Forces of the United States who have participated in Global War on Terrorism operations outside of the areas of eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant was awarded medical personnel MOS 91W and he served with the 2nd Battalion, 325th Infantry Regiment in Iraq. 2. Based on the Military Awards regulation, the CMB is awarded to medical personnel assigned or attached to or under operational control of any combat arms unit of brigade or smaller size on or after 18 September 2001 who satisfactorily perform medical duties while the unit is engaged in active ground combat. 3. His service record is void of evidence and he has not provided any evidence which indicates he was assigned to or under operational control of any combat arms unit of brigade or smaller size that was engaged in active ground combat and that he was physically present during such combat. Therefore, the applicant has not met all of the requirements for award of the CMB. 4. The evidence of record shows the applicant was deployed to Iraq from 15 March to 22 August 2003. Based on his service in Iraq, he is eligible for award of the Iraq Campaign Medal with two bronze service stars. 5. He served a qualifying period of service for award of the GWOTSM; therefore, this award should be added to his DD Form 214. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 by adding award of the Iraq Campaign Medal with two bronze service stars and GWOTSM. 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
