THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Expert Field Medical Badge. 2. The applicant states he is very proud of his accomplishment and would like the badge added to his service record. 3. The applicant provides an Expert Field Medical Badge Certificate of Achievement, dated 15 May 1989. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 27 November 1987. He completed basic training and advanced individual training and was awarded military occupational specialty (MOS) 91A (Medical Specialist). 3. His DA Form 2-1 (Personnel Qualification Record – Part II) indicates he was assigned to Headquarters and Headquarters Troop, 11th Armored Cavalry Regiment, from 17 June 1988 through 6 October 1992 as an ambulance aide driver in MOS 91A. 4. The applicant provided a Certificate of Achievement, dated 15 May 1989, signed by the Commander, 3d Infantry Division Support Command, showing he completed all requirements for award of the Expert Field Medical Badge. 5. On 28 June 1993, he was honorably discharged from the Army for physical disability with severance pay. He completed 5 years, 7 months, and 2 days of net active service. His DD Form 214 does not list award of the Expert Field Medical Badge. 6. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. It states award of the Expert Field Medical Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests. The basic eligibility criteria state enlisted personnel must have an Army Medical Department (AMEDD) primary MOS on active duty or assigned to a Reserve troop program unit or an AMEDD mobilization augmentation agency. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for correction of his DD Form 214 to show award of the Expert Field Medical Badge was carefully considered. 2. Records corroborate the applicant met the basic eligibility criteria for award of the Expert Field Medical Badge. Therefore, it would be appropriate to correct his DD Form 214 to show this badge.
