THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "X98-XX-XXXX" vice "X89-XX-XXXX." 2. The applicant states his SSN was incorrectly listed on his DD Form 214. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 25 May 1965. His DD Form 47 (Record of Induction) did not list his SSN. He used a service number. 3. His record contains a DA Form 41 (Record of Emergency Data), dated 23 July 1966. This form listed his SSN as "X98-XX-XXXX." 4. He was honorably released from active duty and transferred to the U.S. Army Reserve Control Group on 11 May 1967. His DD Form 214 listed his SSN as "X89-XX-XXXX." 5. His record contains Letter Orders Number 05-1078751, issued by the Office of the Adjutant General, U.S. Army Administration Center, St. Louis, MO on 12 May 1971. These orders honorably discharged him from the U.S. Army Reserve and his SSN is listed as "X98-XX-XXXX." DISCUSSION AND CONCLUSIONS: 1. The applicant's request for correction of his DD Form 214 to show his SSN as "X98-XX-XXXX" was carefully considered. 2. It appears the applicant was inducted using a service number. However, his record contains documents to include a DA Form 41 that show he used SSN X98-XX-XXXX during his period of military service. 3. It appears an error occurred during the preparation of his DD Form 214, which resulted in his SSN being incorrectly entered on that form. Therefore, he is entitled to correction of his DD Form 214 to show his SSN as it is listed on his DA Form 41.
