THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the removal of an erroneously filed Presidential Unit Citation (PUC) permanent order from her official military personnel file (OMPF). 2. The applicant states when she submitted U.S. Army Human Resources Command (HRC) Permanent Order 299-16, dated 25 October 2012, for filing in her interactive Personnel Electronic Records Management System records, she inadvertently also submitted HRC Permanent Order 277-10, dated 3 October 2012, for filing. Both orders announced award of the PUC, but only HRC Permanent Order 299-16 lists her unit of assignment during deployment. She would like HRC Permanent Order 277-10 removed from her records to avoid being credited with two PUCs when she is not authorized both. 3. The applicant provides an email from HRC officials advising her to appeal to the Army Board for Correction of Military Records (ABCMR) for removal of the erroneous orders. CONSIDERATION OF EVIDENCE: 1. The applicant is a Regular Army officer serving in the rank of captain. Records indicate she was assigned to Company C, 526th Brigade Support Battalion, 2d Brigade Combat Team, 101st Airborne Division, while deployed in support of Operation Enduring Freedom from 30 May 2010 through 30 May 2011. 2. A review of her OMPF shows it contains both HRC Permanent Order 277-10 and HRC Permanent Order 299-16. 3. HRC Permanent Order 277-10, dated 3 October 2012, awarded the PUC to the following units for extraordinary heroism in action against an armed enemy during the period 13 July to 12 August 2010: * Headquarters and Headquarters Battery, 1st Battalion, 320th Field Artillery Regiment * Battery A, 1st Battalion, 320th Field Artillery Regiment * Battery B, 1st Battalion, 320th Field Artillery Regiment * Detachment, Headquarters and Headquarters Company, 2d Battalion, 502d Infantry Regiment * Detachment, 723d Ordnance Company * Detachment, Company A, Special Troops Battalion, 2d Brigade Combat Team, 101st Airborne Division * Detachment, Company B, Special Troops Battalion, 2d Brigade Combat Team, 101st Airborne Division * 23d Engineer Company * Troop C, 1st Squadron, 75th Cavalry Regiment * Detachment, 807th Expeditionary Air Support Operations Squadron, U.S. Air Force * Detachment, Naval Mobile Construction Battalion 18, U.S. Navy * 1st Battalion, 10th Operational Mentor and Liaison Team, Canadian Army 4. The applicant's records are void of documentation showing she was assigned to any of the units listed in HRC Permanent Order 277-10, dated 3 October 2012. 5. The applicant provided an email from HRC stating the only way to have the erroneously-filed order removed from her records is to petition the ABCMR. 6. Army Regulation 600-8-104 (Army Military Human Resource Records Management) prescribes Army policy for the creation, utilization, administration, maintenance, and disposition of the OMPF. Paragraph 3-6 provides that once a document is properly filed in the OMPF, the document will not be removed from the record unless directed by the ABCMR or other authorized agency. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for removal of HRC Permanent Order 277-10, dated 3 October 2012, announcing award of the PUC for the period 13 July to 12 August 2010 from her OMPF was carefully considered and found to have merit. 2. The evidence of record confirms she was not assigned to any of the units authorized award of the PUC by HRC Permanent Order 277-10, dated 3 October 2012, during the award period cited. Additionally, the applicant herself states she inadvertently included it for filing in her records. 3. In view of the foregoing evidence, it would be appropriate to remove HRC Permanent Order 277-10, dated 3 October 2012, from her OMPF.
