Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his deployments to Kosovo. 2. He states he was deployed to Kosovo from approximately November 1999 to October 2000. 3. He does not provide any additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 11 January 1999. On 1 January 2004, he was honorably released from active duty and credited with completing 4 years, 11 months, and 21 days of active duty service. 3. His DD Form 2-1 (Personnel Qualification Record – Part II) shows he served in Germany from 8 June 1999 to 7 June 2001. 4. His DD Form 214 shows in: * Item 12f (Foreign Service) "0002 00 00" * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the: * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * Expert Marksmanship Qualification Badge with Pistol Bar (9MM) * Marksman Marksmanship Qualification Badge with Hand Grenade Bar * Item 18 (Remarks) no deployment entry 5 The applicant's record is void of any evidence that shows his service in Kosovo. 6. The Defense Finance and Accounting Service (DFAS) confirmed he received hostile fire pay/imminent danger pay and combat zone tax exclusion from 5 June to 14 December 2000 for overseas service in Macedonia. 7 Army Regulation 600-8-22 states the Global War on Terrorism Service Medal (GWOTSM) is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty on or after 11 September 2001 to a date to be determined having served 30 consecutive or 60 nonconsecutive days are authorized the GWOTSM. 8. Army Regulation 635-5 (Separation Documents), in effect at the time, establishes standardized policy for preparing and distributing the DD Form 214. The regulation states that the DD Form 214 is a summary of a Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Paragraph 2-4, in pertinent part, states that for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter in item 18 "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. Although the applicant maintains he served in Kosovo, DFAS verified he received hostile fire pay/imminent danger pay and a combat zone tax exclusion from 5 June to 14 December 2002 for his service in Macedonia. 2. The evidence of record shows he served on active duty on 11 September 2001 and for more than 30 days thereafter which is required for award of the GWOTSM. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 to add to: * Item 13 the Global War on Terrorism Service Medal * item 18 the entry "SERVICE IN MACEDONIA FROM 20000605 TO 20001214." 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
